Your rights and obligations as an Afri Pearl Collections seller include Advertising & Marketing Policy. The following are Terms for Afri Pearl Collections sellers who take advantage of our advertising or marketing services in detail;

Advertising & Marketing Policy

We believe ads should help sellers grow their businesses and contribute to the overall member experience. Afri Pearl Collections offers sellers multiple advertising channels to promote their listings and/or shops. This Advertising & Marketing Policy explains your rights and responsibilities when using Afri Pearl Collections’ advertising services.

This policy is a part of our Terms of Use. By using any of Afri Pearl Collections’ advertising services, you’re agreeing to this policy and our Terms of Use. This Advertising & Marketing Policy may change over time, per the terms of Afri Pearl Collections’ Terms of Use. By continuing to use Afri Pearl Collections’ services you agree to those changes.

1. Afri Pearl Collections Ads

Sellers can purchase paid advertising on Afri Pearl Collections through the Advertising Dashboard in Shop Manager. Afri Pearl Collections Ads display a seller’s listings or shops prominently on Afri Pearl Collections’ websites and mobile apps. Afri Pearl Collections Ads are displayed in one or more locations, such as users’ search results, based on at least four main ranking factors: search relevancy, listing quality (including compliance with Afri Pearl Collections’ policies), the bids (or amount budgeted for bids) to display the listing, and for some listings, likelihood of views or sales. You may choose to promote some or all of your listings or shops as Afri Pearl Collections Ads.

If you had an active campaign in the previous Afri Pearl Collections Ads programme as of 26th December 2020, your budget will be applied by default to the updated Afri Pearl Collections Ads programme. The previous Afri Pearl Collections Ads programme included both onsite ads on Afri Pearl Collections and Google Shopping Ads, whereas the updated Afri Pearl Collections Ads is dedicated to only Afri Pearl Collections onsite ads. You can select which listings to include in Afri Pearl Collections Ads, decide on your budget, or stop your Afri Pearl Collections Ads campaign at any time, in Shop Manager.

Your listings or shops may also be included, at Afri Pearl Collections’ sole discretion, in other marketing and third-party advertising programmes as laid out in Section 5 of Afri Pearl Collections’ Terms of Use.

A. Purchasing Afri Pearl Collections Ads

Afri Pearl Collections Ads are based on an auction for ad space on Afri Pearl Collections’ properties. Afri Pearl Collections enters “bids” for this ad space on your behalf based on a daily budget you set. Specifically, Afri Pearl Collections Ads use a sealed bid generalized second-price auction system to determine the cost and placement of ads. In other words, ad inventory is “auctioned off” at varying prices, depending on the competition. For example, if more Afri Pearl Collections Ads qualify for a particular search query, the auction price may also increase. Therefore, the actual costs you incur will vary depending on the number of participants in the auction and their bid amounts. A bid is the maximum amount of money you will be charged if a buyer clicks on your Afri Pearl Collections Ad. Afri Pearl Collections’ calculation of bids is based on information you provide, such as your daily budget or the listings you wish to include for Afri Pearl Collections Ads. It may also be based on other information collected by Afri Pearl Collections, such as, for example, search relevance, listing variety, listing quality (including seller compliance with Afri Pearl Collections’ policies), or likelihood of views or sale. Afri Pearl Collections Ads fees are charged on a cost-per-click (or “CPC”) basis via a bidding system such as described above, and you are responsible for paying for any clicks your ad receives. This means that you will be charged only when your ad is clicked, not simply when it is displayed. By providing a budget for Afri Pearl Collections to enter bids on your behalf (or providing bid amounts yourself if available), you agree to pay any amount up to and including the bid amount for a click on your ad. Your daily maximum budget can be set at or above a predetermined minimum determined by Afri Pearl Collections and you will not be charged more than your maximum budget on a daily basis. All bids are made in United States dollars (USD). You may pause an ad campaign at any time, but you will still be responsible for any charges incurred prior to pausing your campaign. Afri Pearl Collections is not able to grant refunds for any charges related to clicked ads.

Your ad costs will be visible in your payment account and on the attribution page of the Afri Pearl Collections Ads dashboard, typically within 24 hours of when the fee has been incurred, along with other pending fees, such as listing fees. These costs and fees may be charged on a recurring basis. You can learn more about these, and other fees in our Fees & Payments Policy.

B. Setting an Afri Pearl Collections Ads Budget

You can set a budget to limit the amount you’re willing to pay for Afri Pearl Collections Ads to promote your listings or shops on Afri Pearl Collections. Your daily budget can be set at or above a predetermined minimum set by Afri Pearl Collections and you will not be charged more than your maximum budget on a daily basis. Afri Pearl Collections Ads does not generally permit you to set a cost per click bid amount. In some circumstances, Afri Pearl Collections may decide to allow the setting of a maximum cost per click bid, subject to minimum bid requirements set by Afri Pearl Collections, budget limitations, and the other requirements described above.

For each Afri Pearl Collections Ad, Afri Pearl Collections’ bid management system will automatically determine your bid selection (“auto-bidding”). Auto-bidding is designed to determine the bid price that will deliver positive return on ad spend for a particular listing within a given budget over a day, where those auto-bids are subject to the auction process described above. You understand and acknowledge that Afri Pearl Collections’ auto-bidding system means that Afri Pearl Collections may change your bids at any time, subject to your set budget. If a product permits, you may have the ability to set a maximum cost per click that the auto-bidding system will not surpass.

By default, all of your listings will be promoted by default, including any new listings you create; however, if you are using the Sell on Afri Pearl Collections App to add new listings, you may be asked whether or not you want that new listing included in Afri Pearl Collections Ads. You may also exclude one or more listings manually from Afri Pearl Collections Ads via your Afri Pearl Collections Ads dashboard. If you make any edits to your Afri Pearl Collections listings during your campaign, your ads will be updated automatically to reflect those changes, although those updates may not be instantaneous.

2. Offsite Ads

Afri Pearl Collections purchases offsite advertising from a network of participating providers, such as social networks and search engines. Afri Pearl Collections’ network of participating shopping engines may change at any time. Afri Pearl Collections currently syndicates listings to a variety of channels. Under the Offsite Ads programme, Afri Pearl Collections pays all of the upfront costs of advertising on these providers. If such advertising includes your listing, a buyer clicks on it, and then orders from your shop within 30 days of that click, you will be charged an advertising fee on these orders. Please see our Fees & Payments Policy for information on how the advertising fee is calculated.

A. Participation in Offsite Ads

All Sellers are automatically enrolled in Offsite Ads. Some sellers are able to opt-out of the programme, others are required to participate based on the following criteria: (1) if your shop made $10,000 USD or more total sales in any consecutive 365 day period after 20th February 2020, you will be required to participate in Offsite Ads for the lifetime of your shop even if you fall below that threshold at a later period; and (2) sellers who have not exceeded the $10,000 USD threshold in any consecutive 365 day period after 20th February 2019, or as otherwise required by law, may opt-out of the programme. The consecutive 365-day period will be extended to 366 days during a leap year. Dates are determined Eastern Standard Time.

For the purpose of calculating this $10,000 USD threshold, sales are calculated by multiplying item price by quantity minus any discounts or formally cancelled orders. Please see our Fees & Payments Policy for additional information on how this threshold is calculated. These totals are displayed in your Shop Manager. Beginning a month after initial calculations when the programme starts, Afri Pearl Collections will perform subsequent calculations on the first day of each calendar month and will give you notice if you have crossed the $10,000 USD threshold. Once you hit the $10,000 USD threshold, you are no longer permitted to opt out of Offsite Ads, prior opt outs while under the $10,000 USD threshold no longer apply, and Afri Pearl Collections may promote your listings or shops under the Offsite Ads programme on third-party platforms in our sole discretion, even if you fall below the $10,000 USD threshold at a later date.

If you opt out of Offsite Ads, it may take up to three business days for your listing to no longer be displayed as part of this programme. Afri Pearl Collections may continue to use your listings, including for analytics and marketing purposes, to improve Offsite Ads even if you opt out of allowing Afri Pearl Collections to display your listings in this programme. Even if you opt out, if a buyer clicked on your offsite ad before your opt out is effective, you will still be charged the advertising fee for any orders placed within 30 days of that buyer’s click.

All of your listings or shops may be promoted, including any new listings you create. If you make any edits to your Afri Pearl Collections listings or shop, your ads will be updated automatically to reflect those changes, although those updates may not be instantaneous.

Advertising on third party platforms is subject to the terms and policies set forth by each participating platform, which may be different from Afri Pearl Collections’. You are responsible for complying with the terms and policies of the participating third-party sites, which are linked here and above. By failing to do so, your listing may be removed from Offsite Ads. If your shop, listing, ad or account violates Afri Pearl Collections’ policies, Partner policies, or Afri Pearl Collections determines, in its sole discretion, is not appropriate for Offsite Ads, you, your shop, or one or more of your listings may be restricted from appearing in one or more partner’s channels, or prohibited from participating in Offsite Ads altogether. As always, you are responsible for following Afri Pearl Collections’ Terms of Use, including requirements about Your Content, your Use of Our Services, and our rights to Termination.

If you opt out of, or are otherwise removed from, Offsite Ads, you will still be charged the advertising fee for any orders placed within 30 days of a buyer’s click on your offsite ad, even if that ad is later no longer displayed as part of Offsite Ads.

3. Shop-Specific Promotions

A. Sales and Coupons

Sellers on Afri Pearl Collections may choose to offer promotions specifically for their own shops and/or listings. Afri Pearl Collections currently offers two promotional tools: Sales and Coupons.

A Sale is a promotion that offers free delivery or discounts on your listing price(s) by a percentage. You can run a sale on a single listing or on multiple listings. Sales are public and will be displayed to all buyers, or, if certain seller-selected features are available, to a selected category of buyers. On occasion, Afri Pearl Collections may aggregate Sales and promote them through our websites, apps, and emails. When you run a Sale, you are obliged to follow not just these Afri Pearl Collections Terms but all laws (including consumer protection rules) that apply to sales and promotions in your jurisdiction.

A Coupon is a code that may be redeemed for a discount on an item or free delivery. Coupons are not displayed publicly; as a seller, you may create and distribute Coupons at your discretion. Please note, however, that a Coupon code can be used by any buyer who redeems the code and that a buyer can use a Coupon code on multiple listings and on multiple occasions until any expiration date that you set when creating the Coupon.

Sellers are responsible for following Afri Pearl Collections’ policies and all applicable laws associated with Sales and Coupons. For Sales, it’s your responsibility to set the terms and conditions for the promotion in the ‘Sale details’ section. For Coupons, it’s your responsibility to communicate any terms or limitations for the promotion to buyers when sharing the Coupon code. Sales and Coupons may not be used for fee avoidance.

B. Targeted Offers

Afri Pearl Collections’ Targeted Offers is a free marketing tool that allows you to offer a Coupon to specific audiences of buyers who have interacted with your shop by either favoriting one of your listings or adding one of your listings to their basket. As with all Coupons, a coupon sent through the Targeted Offer tool can be used by any buyer that redeems the code. It can also be used on multiple listings and on multiple occasions. Targeted Offers is a free service to you, but please note that you will not be able to limit the number of sends if you opt – in to sending coupons through the Targeted Offer tool. If you wish to discontinue Target Offers, you can manage or turn off your campaigns at any time from your Sales and Coupons dashboard. You also have the option to automatically send a Coupon free of charge as a thank you to buyers who have made a purchase from your shop. Afri Pearl Collections may change or stop this service at any time upon notice to you.

Please note that Coupons will only be sent to buyers who have opted in to receive Coupons via email from Afri Pearl Collections sellers.

4. Disclaimers

Afri Pearl Collections reserves the right to change the terms of these advertising programmes at any time, including addition of fees, addition or removal of platforms, or end the programme (in whole or part) at any time. We will notify you of major changes.

Using advertising and promotional services through Afri Pearl Collections does not constitute an obligation on Afri Pearl Collections’ part to display an ad or promote your listings or shops. Afri Pearl Collections can’t guarantee that a displayed ad or promotion will be clicked, and we can’t guarantee that if a user clicks that the related listing will be sold.

Afri Pearl Collections’ advertising services and advertising policies change over time, as do those of Afri Pearl Collections’ third party channel partners, and neither Afri Pearl Collections nor its third party channel partners guarantee any particular programme’s features, results, or third party channels. Afri Pearl Collections reserves the right to change or terminate any campaign, incentive offer, or a programme in part or as a whole at any time.

Afri Pearl Collections may, and you give Afri Pearl Collections permission to, automate parts or all of an advertising service provided, including combining bids across listings, geographical regions, keywords, ad formats, verticals, and on and off-Afri Pearl Collections marketing channels and platforms. You give Afri Pearl Collections permission to do so, with notice from Afri Pearl Collections, even if those features or options replace the parameters and options you set for the particular advertising service.

In the event Afri Pearl Collections begins, ends or modifies an advertising service, you give Afri Pearl Collections permission to transfer your bids, budgets, and campaigns to that new programme, to the extent transferable for the defaults and features of the new or modified advertising service. Afri Pearl Collections will provide notice in the event of any such transfer.

You may be given the opportunity to participate in beta tests of advertising services offered by Afri Pearl Collections and/or third-party channels. Those beta services are subject to separate terms for a particular programme provided to you as part of your participation in that programme, as well as this policy and the overall Afri Pearl Collections Terms.

From time-to-time Afri Pearl Collections may test or experiment with additional advertising products and the advertising services offered by Afri Pearl Collections, as well as the look and feel of any type of advertisement, may change as our programmes and platforms evolve.

Ads and promotions may not include content that infringes upon or violates the rights of any third party, including copyright, trademark, privacy, publicity, or other personal or proprietary rights.

Please see our Intellectual Property Policy for more information. You are responsible for ensuring that your ads and promotions comply with all applicable laws and regulations.

Afri Pearl Collections reserves the right to reject or remove any ad or promotion for any reason, in our sole discretion, including marketing that negatively affects our relationships with our members or partners.

Anti-Discrimination and Hate Speech Policy

These are the Behaviour we prohibit on Afri Pearl Collections shopping platform. Afri Pearl Collections connects thoughtful consumers around the world with creative entrepreneurs. It’s an ecosystem where people of all backgrounds inspire each other and build relationships through making, selling, and buying unique goods. We want everyone on Afri Pearl Collections to feel safe, and our priority is fostering an inclusive environment. This policy explains the kind of behaviour we prohibit on Afri Pearl Collections to make sure we all have a positive experience.

This policy is a part of our Terms of Use. By using Afri Pearl Collections, you’re agreeing to this policy and our Terms of Use.

Afri Pearl Collections prohibits the use of our Services to discriminate against people based on the following personal attributes (collectively, “protected groups”):

• Race

• Colour

• Ethnicity

• National origin

• Religion

• Gender

• Gender identity

• Sexual orientation

• Disability

• Any other characteristic protected under applicable law

It is your responsibility to know your local laws and any other legal regulations on discrimination that might apply to you. Additionally, Afri Pearl Collections does not allow hate speech. Hate speech occurs when violent, offensive, derogatory or demeaning language is directed at a person or group based on their one or more protected group attributes.

Whether you’re engaging with public features on Afri Pearl Collections, such as listing items, using community spaces, and writing reviews, or having direct communication with other members of the Afri Pearl Collections community, such as via Messages, discrimination and hate speech are not allowed. As a seller on Afri Pearl Collections, your shop content, including shop announcements and shop policies, cannot display discriminatory behaviour toward protected groups. Examples of prohibited behaviour include, but are not limited to:

• Refusal of service based on membership in one or more protected group

• Expressing intolerance or a lack of respect for another member on the basis of protected group attributes

• Having a shop policy that excludes sales to members of one or more protected groups listed above

• Directly or indirectly making derogatory or demeaning remarks against protected groups listed above

• Racial slurs

• Posts that support or glorify hate groups and their members

If you think discrimination or hate speech has occurred on Afri Pearl Collections, please report it by emailing us at syrillkizza@gmail.com, and we will investigate. If you see a listing on Afri Pearl Collections which you believe violates our Prohibited Items Policy, including prohibited hate items, we encourage you to flag the item by using the Report this item to Afri Pearl Collections link at the bottom of each listing page. We have a timely review process for all reports.

Community Policy

Community is at the heart of all we do at Afri Pearl Collections. Afri Pearl Collections sellers use community spaces to find inspiration, share knowledge, discuss ideas, and build relationships that help them grow their businesses.

The Afri Pearl Collections Community includes the Forums, Teams, and the Seller Handbook. This policy is a part of our Terms of Use. By using any of Afri Pearl Collections’ community spaces, you’re agreeing to this policy and our Terms of Use.

1. Using the Afri Pearl Collections Community

Afri Pearl Collections community spaces are public areas where sellers can interact with one another. Sellers who use any of the community spaces must be over 18 years old. To make sure that the Afri Pearl Collections community continues to be a place that’s safe, welcoming and respectful, you agree to comply with the following policies in all community spaces:

  1. Respect other members’ privacy, and protect your own. Don’t share private or personally identifying information in public areas of the site. This includes, but is not limited to, transaction details, personal contact details and the verbatim contents of private correspondence.
  2. Do not use community spaces to discuss interactions with Afri Pearl Collections representatives, or to share verbatim extracts of such conversations ( i.e., emails, DMs or messages, live chats etc.). Remember, most messages between you and Afri Pearl Collections are considered private correspondence and we ask that you respect this confidentiality. Please refer to our Privacy Policy for more information.
  3. Be honest and transparent about who you are. Don’t use a fake identity.
  4. Be respectful towards other sellers and, when in doubt, lead with kindness, assume best intentions and act on that basis. Don’t use community spaces to publicly disparage a specific seller, an Afri Pearl Collections representative, shop, listing or category of item.
  5. Don’t use community tools or spaces to interfere with another seller’s business.
  6. Don’t spam. This includes unsolicited or duplicate posts or links to your shop, fundraisers, surveys, social media, or other promotional content.
  7. Don’t use community spaces to coordinate pricing or discuss fee avoidance with other sellers.
  8. Don’t use community spaces to harass other sellers. Similarly, don’t post content in community spaces that may promote, support, or glorify hatred, misinformation, or that would be in violation of Afri Pearl Collections’ policies including our Anti-Discrimination Policy.
  9. Don’t publish or post threats of violence against others or promote or encourage others to engage in violence or illegal activity.
  10. Don’t engage in illegal activity or activity that infringes someone’s intellectual property, or encourage others to engage in that type of activity.
  11. Don’t use community spaces to encourage others to violate Afri Pearl Collections’ policies.
  12. Continue reading below for some additional policies that apply to you while using specific community spaces.

2. Forums

Forums is a public space where sellers can gather with other sellers to discuss their Afri Pearl Collections businesses.

By using Afri Pearl Collections’ Forums, you acknowledge and agree that:

  1. Your role is to help us create a safe space for sellers to learn from one another and grow their businesses.
  2. Your contributions help us build a public database of valuable knowledge and experiences that are available to everyone.
  3. Tone is challenging to interpret on a public forum and our community spaces are for Afri Pearl Collections sellers at every level. When in doubt, lead with empathy and kindness.
  4. Your posts will stay on topic. Off topic posts may be removed.
  5. Your posts in the Forums are permanent and can be viewed in various places including your User Profile (unless they are removed by Afri Pearl Collections).
  6. Your posts should be helpful, constructive, and encouraging when voicing dissent or criticism. Don’t harass, target, insult, troll, or call out other members or Afri Pearl Collections representatives.
  7. Moderators may take certain actions to keep the Forums welcoming, organized, and helpful for everyone. Such actions are not up for public discussion.
  8. You will respect others’ opinions and report content responsibly. Flagging posts is reserved for content that specifically violates Afri Pearl Collections’ policies.
  9. Afri Pearl Collections reserves the right to remove content from the Forums at any time for any reason, including, for example, violation of our policies, removal of dormant content, content that causes privacy issues, or due to changes to how the Forums operate.
  10. If you have concerns about actions taken in the forums, you can follow these instructions to contact Afri Pearl Collections Support.

3. Direct Messages

Members may send each other direct messages using the Community’s built-in messaging system. These messages are separate from Afri Pearl Collections Messages and can be accessed and read when you are in community spaces.

By using direct messages in the Afri Pearl Collections Community, you agree to all of the above policies. In addition, you may not send messages that are considered:

  1. Abusive, threatening, defamatory, harassing, or otherwise in violation of our Anti-Discrimination Policy.
  2. Obscene or vulgar.
  3. Unsolicited advertising or promotions.

If you receive an inappropriate message, follow these instructions to report it.

4. Teams

Afri Pearl Collections Teams is a community feature where you can connect with Afri Pearl Collections sellers to help you grow your business. Afri Pearl Collections Teams are self-organized by members and not run by, part of, or affiliated with Afri Pearl Collections.

By using Afri Pearl Collections’ Teams feature, you acknowledge and agree that:

  1. Except as set forth below, Afri Pearl Collections is not responsible for or involved in a team’s membership policies, dues, finances, or any other actions.
  2. Teams that do not comply with Afri Pearl Collections’ policies, including our Anti-Discrimination Policy, may be removed, and Afri Pearl Collections reserves the right to remove a team for any reason.
  3. Afri Pearl Collections will not mediate disputes between teams and outside parties, nor disputes between teams and team members.
  4. Afri Pearl Collections will not monitor third-party forums or other independent team sites.
  5. Any use of the term “Afri Pearl Collections,” Afri Pearl Collections’ visual marks such as the stylized Afri Pearl Collections name logo or “E” logo, other Afri Pearl Collections Trademarks (all trademarks worldwide owned by Afri Pearl Collections Ltd, and its affiliates), or marks confusingly similar to the Afri Pearl Collections Marks must comply with Afri Pearl Collections’ Trademark Policy and our Team branding guidelines. See below for more details.
  6. A team may not use mature, profane, or hateful language or images in the team’s name, banner, or logo.
  7. A team may not be used for the sole purpose of redirecting traffic to another web location. Afri Pearl Collections reserves the right to remove links on any profile page or team page for any reason. Unsolicited promotion or advertisement from representatives or affiliates of outside services, websites or other products is not allowed.
  8. Teams are created by and run by Team Captains. A team must have a Captain in place in order to function successfully.
  9. Team Captains are responsible for moderating their Team’s content. In addition, Team Captains may appoint additional roles and responsibilities to their members.
  10. Teams that are inactive for 6 months or more, or who do not have a Team Captain in place to moderate the Team, are subject to removal from the platform and cancellation at Afri Pearl Collections’ discretion. This includes revocation of the right to use Afri Pearl Collections’ name or the Afri Pearl Collections Trademarks.
  11. Team forums and on-site publications (i.e., blogs and knowledge base articles) are subject to this Community Policy and may not be used to demonstrate or discuss disputes with other members or with Afri Pearl Collections.
  12. A team may have a charter detailing membership requirements and expectations for the team. Team leadership is responsible for enforcing the team’s charter. A team’s charter must abide by all of Afri Pearl Collections’ policies, including our Terms of Use and Intellectual Property Policy.
  13. If a team chooses to use a dedicated item listing tag (also called a “team tag”), it must contain the word “team”. Afri Pearl Collections will not mediate disputes regarding use of team tags on item listings.

5. Branding Guidelines for Teams and Captains of Teams

Teams must adhere to these branding guidelines when identifying as an Afri Pearl Collections Seller Team.

You can use the word Afri Pearl Collections in the name of your Team. (e.g. Afri Pearl Collections Greek Team, Brighton Afri Pearl Collections Team). However, you can’t use the term ‘Afri Pearl Collections’ alone, or the Afri Pearl Collections logo by itself in your Team name, or in any promotional materials that reference your Team in any manner.

Things to keep in mind when creating an Afri Pearl Collections Team Logo:

• You cannot use the Afri Pearl Collections logo to promote your Team without your Team name included at any time.

• list text here, You can create a stand-alone Afri Pearl Collections Team logo so long as your Team name is clearly presented on the logo image.

• If you use the word “Afri Pearl Collections” in your Team logo, you must make sure it is not the most prominent or the largest word visually on the logo image.

• If you are promoting your Team or any Team related activities, you must include the terms “Organized by a Team of Afri Pearl Collections sellers” visibly and prominently. It is also your responsibility to make it clear that you are not an agent or employee of Afri Pearl Collections. -You are solely responsible for any costs relating to your use of all promotional materials, venues or other items used to promote your Team.

Afri Pearl Collections does not pre-approve Team branding and we reserve the right to take action on any usage brought to our attention that causes confusion, potential harm to the Afri Pearl Collections brand, or is in direct violation of our Trademark Policy. In particular:

Teams’ use of the Afri Pearl Collections name and Afri Pearl Collections Trademarks is subject to periodic Afri Pearl Collections’ review at any time, and Afri Pearl Collections may require changes in your use of the Afri Pearl Collections Trademarks to comply with Afri Pearl Collections policies, including our Trademark Policy, Afri Pearl Collections’ marketing needs, or to ensure Afri Pearl Collections’ Trademarks are not used in a way that suggests your Team is affiliated with, or part of Afri Pearl Collections, Inc. In addition, you may not use the Afri Pearl Collections Trademarks or similar marks in a way that tarnishes or causes harm to Afri Pearl Collections’ brand or reputation, or in relation to non-Afri Pearl Collections services. At Afri Pearl Collections’ sole discretion, including if you violate this policy, or any of Afri Pearl Collections’ Terms of Use, Afri Pearl Collections reserves the right to revoke your right to use the Afri Pearl Collections Trademarks.

6. Afri Pearl Collections Local

Afri Pearl Collections Local connects buyers with Afri Pearl Collections sellers who are participating in fairs and markets in their area. Buyers can shop from sellers in person, supporting both the Afri Pearl Collections community and their own local economies.

In order for your event to qualify for Afri Pearl Collections Local, it must be:

• Held at a physical location

• Open to the public

• A limited-time engagement

Here are some examples of events that can be promoted with Afri Pearl Collections Local:

• Craft fairs

• Markets

• Pop-up shops

• Special events

The following are not eligible for Afri Pearl Collections Local:

• Online/virtual events

• Art galleries or studios (unless your event will take place in an art gallery or studio)

• Brick and mortar shops (unless your event will take place in a brick-and-mortar shop, like Small Business Saturday)

While you may describe your event as organized by Afri Pearl Collections sellers, you may not prominently use the Afri Pearl Collections name or logo in a manner that suggests the event is organized or run by Afri Pearl Collections. You are required to only use assets approved for Afri Pearl Collections Local for use of the Afri Pearl Collections name or Afri Pearl Collections Trademarks. Afri Pearl Collections may periodically review your use of the Afri Pearl Collections name and Afri Pearl Collections Trademark, and may revoke your right to use the Afri Pearl Collections name or Afri Pearl Collections Trademarks may be revoked by Afri Pearl Collections at any time, for any reason.

Afri Pearl Collections may take action, including termination or suspension, on any account that violates these policies. For example, we may temporarily or permanently suspend your community posting privileges, remove your community access or close your Afri Pearl Collections account, which will immediately suspend all Afri Pearl Collections shop activity. If we do so, it’s important to understand that you don’t have a contractual or legal right to continue to use our Services, including Community spaces or the Afri Pearl Collections Trademarks. Generally, Afri Pearl Collections will notify you that your account has been terminated or suspended, unless you’ve repeatedly violated this policy or our Terms or we have legal or regulatory reasons preventing us from notifying you.

Fees & Payments Policy

Sellers may be charged for using some of Afri Pearl Collections’ services. This Fees & Payments Policy explains your fees and taxes and how to pay them.

This policy is a part of our Terms of Use. By opening an Afri Pearl Collections shop, you’re agreeing to this policy and our Terms of Use.

1. Types of Fees

Sellers may be required to pay the following types of fees. Please note that all fees are listed exclusive of any value-added tax (VAT) or similar taxes that may apply. See the Taxes section below for further details.

Listing Fees

You will be charged a listing fee of $10 USD for each item that you list for sale on Afri Pearl Collections.com or Afri Pearl Collections’ mobile apps. For items already listed on your Afri Pearl Collections shop, there are no additional listing fees to list items on your Pattern site. Listings that you only make available on your Pattern site do not incur a listing fee. You will only be charged a listing fee for creating or renewing a listing on Afri Pearl Collections; there is no fee for editing a listing. You will be charged a listing fee whether or not the listed item sells, unless you create a private listing, in which case you will only be charged the listing fee when the private listing is sold. Afri Pearl Collections.com listings expire after four months. Pattern-only listings do not expire. If you list multiple quantities of the same item, the initial listing fee will be $10 USD, and the listing will be automatically renewed at $10 after each of the items sells. You can read more about fees for multiple listings in this Help article. Listing fees are reflected in your payment account and deducted at the time the listing is published or renewed. It’s important to note that listing fees are non-refundable.

Auto-renew. Afri Pearl Collections’ automatic renewals feature will automatically renew your listings at the end of the four-month listing period, unless you choose to not use automatic renewals for a particular listing or for your shop. You will be charged the listing fee of $0.20 USD for each of these listings until you cancel automatic renewals. You can see automatic listing status in your Listings Manager, and may cancel automatic renewals at any time by selecting “Manual” instead of “Automatic” in the “Renewal Options” in the Listings Manager. Once you cancel, you will only be charged for the current listing period.

Transaction Fees

When you make a sale through Afri Pearl Collections.com, you will be charged a transaction fee of 5% of the price you display for each listing plus the amount you charge for delivery and gift wrapping. If you are an Afri Pearl Collections Payments user and you list your items in a currency other than your payment account currency, see the Currency Conversion section below for more details on the transaction fee. If you sell from the US or Canada, the transaction fee will not apply to sales tax, Goods and Services Tax (“GST”), or Harmonised Sales Tax (“HST”), unless you have included those charges in your listing price. If you sell from anywhere other than the US and Canada, the transaction fee will apply to the listing price (which should include any applicable taxes), postage price, and gift-wrapping fee. If you offer optional personalization for an additional fee, the additional fee for personalization is added to the listing price you display and the total display price is subject to the same transaction fees described in this Section. See the Taxes section below for more information about whether you are required to include applicable taxes in your listing prices. Transaction fees are deducted from your current balance as each sale occurs, and are reflected in your payment account.

Advertising and Promotional Fees

Afri Pearl Collections offers multiple services to help you advertise your listings and promote your shop, including Afri Pearl Collections Ads and Offsite Ads. If you use Afri Pearl Collections Ads, you select your daily maximum budget, as set forth in more detail below. For Offsite Ads, fees are only charged if Afri Pearl Collections’ advertising your listing directly results in a sale, as set forth in more detail below. For more information, please see the Advertising & Marketing Policy.

Afri Pearl Collections Ads Fees

If you purchase paid advertising on Afri Pearl Collections through the Advertising Dashboard in Shop Manager, you can set a budget to limit the amount you’re willing to pay for Afri Pearl Collections Ads to promote your listings or shops on Afri Pearl Collections. Your daily maximum budget can be set at or above a predetermined minimum set by Afri Pearl Collections, and you will not be charged more than your maximum budget on a daily basis. All bids are made in United States dollars (USD). Afri Pearl Collections Ads fees may be charged on a recurring basis and are deducted from your current balance and reflected in your payment account. For more information, please see the Advertising & Marketing Policy.

Offsite Ads Fees

Afri Pearl Collections purchases offsite advertising from a network of participating partners, such as social networks and search engines. If such advertising includes your listing, a buyer clicks on it, and then orders from your shop within 30 days of that click, you will be charged an advertising fee on these orders (which we’ll refer to collectively as “Attributed Orders” and individually as an “Attributed Order”).

The Offsite Ads fee you are charged for Attributed Orders depends on your shop’s sales over the prior 365 days, as follows:

1. The standard fee you will pay is 15% on Attributed Orders, unless the 12% fee applies as described below.

2. If your shop has made less than $10,000 USD in sales over the prior 365 days (going back to 20th December 2020 and later), as calculated on the first day of the month, you will pay a fee of 15% (as described in the section below) on Attributed Orders, unless you opt out of participation in Offsite Ads for the duration your shop is under the $10,000 USD threshold. The 15% fee and opt-out apply until or unless you at any time meet the $10,000 USD threshold.

3. If at any time your shop has made sales of $10,000 USD or more over the prior 365 days (going back to 20th February 2019 and later), as calculated on the first day of the month, you will subsequently pay a fee of 12% (as described in the section below) on Attributed Orders, as of the beginning of the programme if you immediately qualify, and otherwise on the first day of the month following qualification. If you subsequently fall below the $10,000 USD threshold at a later date, you will still only be charged a 12% advertising fee for the lifetime of your shop. If you opted out of participation in Offsite Ads prior to meeting the $10,000 USD threshold, you will be required to participate and will be charged a 12% advertising fee on Attributed Orders for the lifetime of your shop upon reaching the $10,000 USD threshold. The prior opt out while under the $10,000 USD threshold will no longer apply (even if you subsequently fall below the $10,000 USD threshold at a later date).

4. Beginning a month after initial calculations when the programme starts, Afri Pearl Collections will perform subsequent calculations on the first day of each calendar month and will give you notice if you have crossed the $10,000 USD threshold.

For the purpose of calculating this $10,000 USD threshold, sales are calculated by multiplying item price by quantity (minus any discounts or formally cancelled orders), but excluding Pattern orders, In Person Payment orders, Afri Pearl Collections fees, or separately charged postage, taxes, or gift wrap. For sellers with shop currencies other than USD, the $10,000 USD threshold is calculated with the currency exchange rates used by Afri Pearl Collections at the time that the relevant sales were processed. Exchange rates used are variable and are provided by a third-party financial services company. For information on how the $10,000 USD threshold is calculated, please see the next section and the Advertising & Marketing Policy.

How Offsite Ads fees are calculated:

Offsite Ads fees apply to Attributed Orders and are charged as a percentage of the total order amount, which comprises the price you display for each listing plus the amount you charge for postage and gift wrapping and, in some jurisdictions, taxes, as set forth below. The applicable percentage charge, either 12% or 15%, is determined as described above.

If you are an Afri Pearl Collections Payments user and you list your items in a currency other than your payment account currency, see the Currency Conversion section below for more details on Offsite Ads fees. If you sell from the US or Canada, Offsite Ads fees will not apply to sales tax, Goods and Services Tax (“GST”), or Harmonised Sales Tax (“HST”), unless you have included those charges in your listing price. If you sell from anywhere other than the US and Canada, Offsite Ads fees will include any applicable taxes. If you offer optional personalization for an additional fee, the additional fee for personalization is added to the listing price you display and the total display price is subject to the same Offsite Ads fees described in this Section. There is no limit to the number of Offsite Ads fees you may be charged on Attributed Orders, but the total Offsite Ads fee you’ll pay on a single Attributed Order will not exceed $100 USD. Offsite Ads Fees are deducted from your current balance and are reflected in your payment account.

Subscription Fees

Afri Pearl Collections sellers in good standing may opt-in to Afri Pearl Collections Plus, a subscription package offering an expanded set of tools for growing brands. The fee for an Afri Pearl Collections Plus subscription is $10 USD per month. Afri Pearl Collections Plus subscription fees are deducted from your current balance each month and reflected in your payment account. Where applicable, Afri Pearl Collections will charge sales tax on your monthly subscription fee for sellers located in the United States.

Auto-renew. Subscription fees will be added to your payment account on the same day every month in your domestic currency. For example, if you sign up on 5th March, your subscriptions fees will be added on 5th April, 5th May, and so on. When you sign up at the end of the month, your subscription fees will be charged to your payment account on the last day of the month. For example, if you sign up on 31st May, your subscription fees will be added on 30th June because that is the last day of the month. You can cancel your Afri Pearl Collections Plus subscription anytime by visiting the Your Subscription section of your Shop Manager’s Settings. You will have access to your Afri Pearl Collections Plus subscription until the end of that subscription cycle, and your final day of access will be identified in the Your Subscription dashboard. After your Afri Pearl Collections Plus subscription has ended, your shop will return to Afri Pearl Collections Standard, and you will no longer have a subscription fee added to your payment account. While you are subscribed to Afri Pearl Collections Plus, you are provided with the following credits each subscription cycle:

• 15 listing credits, which are visible as $3 USD in listings credit in your payment account

• $5 USD in Afri Pearl Collections Ads credits, which are visible in your payment account and on your advertising management page

You must use the credits during the subscription cycle, otherwise they expire. Credits will not roll over month to month. They will be reset and replenished at the beginning of each subscription cycle.

Afri Pearl Collections Plus subscribers have the option to register free “. store” domains and get 50% off select domain extensions like “.com”, “.net”, and “.ca” through our third-party provider partner, Hover. This discount is valid for the first year of domain registration. If you purchase a new custom web address through Hover, you’ll be navigated to Hover to select the details and complete the purchase. By subscribing to Afri Pearl Collections Plus, your first year of domain hosting subscription will be available for discount. When your domain needs to be renewed after a year, it will be subject to Hover’s normal pricing structure (without the Afri Pearl Collections Plus discount). In-Person Selling Fees

You can use the square reader to process payments for in-person sales. You have the option to sync your Afri Pearl Collections listings with Square. If you choose to sync your listings with Square, listings with multiple quantities will be charged the same $10USD renewal fee as listings with multiple quantities on Afri Pearl Collections. Non-synced listings will be charged a $10USD transaction fee, which will appear on your payment account as a “Square manual” fee. In-person selling fees are deducted from your current balance and reflected in your payment account. For more information about in-person selling fees, please see this Help article.

In-person sales processed with the square reader will not be subject to Afri Pearl Collections’ 5% transaction fee or any Afri Pearl Collections payment processing fees, but will be subject to Square’s Payment Processing Fees.

Payment Processing Fees

Online Sales. Eligible Afri Pearl Collections shops may use Afri Pearl Collections Payments to accept certain payments through Afri Pearl Collections (learn more about Afri Pearl Collections Payments below). Afri Pearl Collections charges a payment processing fee for each transaction through Afri Pearl Collections Payments. Payment processing fees vary based on the location of your bank account. In certain markets, Afri Pearl Collections may also charge a fixed deposit fee for disbursing seller funds that are under certain designated thresholds. See the Afri Pearl Collections Payments Policy to find payment processing fees and where applicable, deposit fees, by country. The payment processing fee is assessed on the total amount of the sale, including tax and postage. Payment processing fees are deducted from the sale amount in your payment account. Deposit fees are deducted from your Available Funds and reflected in your payment account at the time of your scheduled deposit.

Delivery Fees

Afri Pearl Collections offers sellers in certain locations the ability to purchase postage labels to fulfill their orders. The cost of the postage label will depend on the delivery carrier, and the origin, destination, weight, and dimensions of the package. If you add signature confirmation or insurance, those fees will be added to the total cost of the label at the point of purchase. Sellers who purchase postage labels may also purchase parcel insurance through licensed insurance carriers. US Sellers who purchase USPS postage return labels will be charged after delivery of the returned package. You must accept Afri Pearl Collections Payments or PayPal as payment methods to purchase postage labels through Afri Pearl Collections. Postage fees and any adjustments are reflected in your payment account and deducted from your current balance.

Regulatory Operating Fees

Sellers in certain countries will be charged a Regulatory Operating fee on each transaction. A Regulatory Operating fee is a fixed percentage of the price you display for each listing plus the amount you charge for postage, which should include applicable taxes, (including gift wrapping and personalisation, if applicable) and is charged, where applicable, in addition to other fees described in this Policy. Regulatory Operating fees may vary per country and are charged as a result of the increased cost of operating in the relevant country, for example, as a result of additional costs of compliance with applicable regulation(s). You can find the countries in which Regulatory Operating fees apply as well as the specific percentage fees for each country in this help article.

Pattern Fees

You can try our Pattern tool to create a personalized website for free for 30 days. After the 30-day free trial, you’ll be charged a monthly subscription fee of $15.00 USD. Where applicable, Afri Pearl Collections will charge sales tax on your monthly subscription fee for sellers located in the United States. Your first month’s fee will be pro-rated, and you will be charged the full subscription fee for each subsequent month you use Pattern. If you purchase a domain name through our partner Hostinger, Inc., you will also be charged a fee to register the domain name and for any related services you purchase from Hostinger.

Auto-renew. Your subscription fee will automatically renew on the first of the month at 12:01am Eastern Time (5:01am GMT). You can turn your subscription off at any time by clicking “Cancel Pattern” from the Pattern settings on your dashboard or from your payment account. If you switch off the service after your subscription renews on the first of the month, you’ll still be responsible for paying the full subscription fee for that month.

All Pattern fees are reflected in your payment account and deducted from your current balance. For more information, please see the Pattern Policy.

Currency Conversion

With the exception of the transaction fee, Offsite Ads fees, the Payment Processing fee, Regulatory Operating fees, and deposit fees, Afri Pearl Collections converts fees from USD to your payment account currency at the market rate at the time the fee is reflected in your payment account. All fees appear in your payment account in your domestic currency. However, Afri Pearl Collections Payments users located in Bulgaria, Croatia, Czech Republic, Hungary, Poland, and Romania will have all fees deducted from their payment account in their designated payment account currency, the Euro.

Transaction fees, Offsite Ads fees, Regulatory Operating fees: If you list your items in a currency other than that of your payment account, the transaction fee and, where applicable, the Offsite Ads fee and Regulatory Operating fee will be converted to your payment account currency at the market rate and reflected in your payment account.

To avoid incurring foreign exchange charges on your sales, Afri Pearl Collections recommends you list your items in the same currency as your payment account currency. Buyers see the items in the currency of their choosing. As an Afri Pearl Collections Payments user, if you decide to list in a currency other than that of your payment account, you will be charged a 2.5% currency conversion fee on the sale amount to send funds to your payment account. Learn more about currency conversion here. Currency conversion is handled automatically by our payment processing service and further described in our Afri Pearl Collections Payments Policy.

2. Fee Avoidance

Any action by a seller to avoid paying a fee is considered fee avoidance and is strictly prohibited by Afri Pearl Collections. This includes, for example, encouraging buyers to purchase an item in your Afri Pearl Collections shop through another venue. A transaction initiated on Afri Pearl Collections may not be completed off of Afri Pearl Collections. The price stated in each listing description must be an accurate representation of the sale. Sellers may not alter the item’s price after a sale for the purpose of avoiding Afri Pearl Collections transaction fees, misrepresent the item’s location, or use another user’s account without permission.

3. Paying your Afri Pearl Collections Fees

Afri Pearl Collections will automatically deduct all fees owed from your payment account. Provided you have sufficient funds in your payment account no further payment action is required. If your payment account does not contain sufficient funds, you are responsible for paying any fees owed in full within 15 days of the date of your monthly statement, or the account will be considered past due, and Afri Pearl Collections may charge your card on file or take other actions to collect funds as laid out in the Recoupment section of Afri Pearl Collections’ Payments Policy. If you make a sale while you have an outstanding balance the net sale amount will be applied to your outstanding balance. You may pay your outstanding balance manually by credit card, debit card, or PayPal. US sellers may also enroll in Auto Billing, Afri Pearl Collections’ automatic outstanding fee payment option.

Your statement is available in your payment account at the beginning of each month, and will detail all sales and fees activity from the preceding month. You can learn more about paying your outstanding balance in this Help article.

Afri Pearl Collections may suspend your selling privileges at any time pending payment of your outstanding balance.

Auto Billing (US Sellers Only)

By enrolling in Afri Pearl Collections’ automatic payment plan (“Auto Billing”), any outstanding fees not covered by the funds in your payment account will be charged to the credit card you have on file on the first of the month or when your current balance is greater than or equal to your fee threshold. To use the plan, you agree to the following terms.

A. You authorize Afri Pearl Collections to keep your payment card information on file and to charge the card on file on the first day of each calendar month for the previous month’s outstanding charges and at any time the balance of fees reaches the designated fee threshold for your account. Upon enrollment, Afri Pearl Collections will charge your current balance to the card on file.

B. When your card account is debited, Afri Pearl Collections will send you an email with the amount charged. You can also review this information by accessing your account on Afri Pearl Collections.

C. If your card account on file with us is closed, the account number is changed, or a charge is rejected by your card issuer, you must update your card information or add a new card number in your Afri Pearl Collections account. If your charge is refused by the issuer for any reason, your Afri Pearl Collections account may be suspended or terminated, and you are still required to pay your outstanding balance by some other means. Your authorization applies to any successor or replacement card you or your card issuer provides.

D. You may cancel Auto Billing and change to manual payment by updating your payment settings in your Afri Pearl Collections account. Afri Pearl Collections requires a reasonable period of time to act after we receive your notice. This means that an additional automatic payment may be made to your card account while we are processing your request.

E. Suspended or terminated members remain obligated to pay Afri Pearl Collections for all unpaid fees.

4. Afri Pearl Collections Payments

Afri Pearl Collections Payments enables sellers to accept various forms of payment in their local currencies while using Afri Pearl Collections’ services. Sellers registered for Afri Pearl Collections Payments can accept payment by credit card, debit card, Afri Pearl Collections Gift Card and Afri Pearl Collections Credit, PayPal, some bank transfer services, Apple Pay and Google Pay.

5. Taxes

Aside from the limited circumstances set out below, you are responsible for collecting and paying any taxes associated with using and making sales through Afri Pearl Collections’ services. Afri Pearl Collections will issue 1099-K forms to certain sellers to comply with IRS and state requirements. You may opt in at any time to receive your 1099-K form electronically. You can learn more in this Help article.

A. Listing your items on Afri Pearl Collections

If you sell physical goods on Afri Pearl Collections and reside in the US or Canada, you may utilize our sales tax tool to calculate the tax owed on each sale. US sellers can learn more about collecting sales tax in this Help article.

If you sell on Afri Pearl Collections and reside outside of the US or Canada, you need to include applicable taxes in your listing prices. You can learn more about this requirement to display tax-inclusive pricing in this Help article. Please note that while some countries may refer to VAT using other terms, e.g. GST, we’ll just refer to VAT, GST, and any local sales taxes collectively as “VAT” unless the context requires otherwise.

Where Afri Pearl Collections is required to collect sales tax/VAT on your behalf, Afri Pearl Collections will use the category you assigned to each listing to calculate, collect and remit the applicable taxes. You are solely responsible for ensuring that all of your listings are properly categorized, and you agree to indemnify Afri Pearl Collections for any losses it incurs in connection with any mis-categorization of your listings by you.

Please remember that Afri Pearl Collections’ fees do not include any withholding taxes that might apply in your home country. You are required to pay Afri Pearl Collections the full amount of our fees and may not deduct any applicable withholding taxes from that amount.

Please also note that some countries require Afri Pearl Collections to apply VAT on the fees that you may be charged in accordance with this policy, and that the fees listed in this policy are exclusive of VAT. See this Help article for more information on VAT.

B. Taxes on Seller Services

Sales Tax on Subscription Fees

Where applicable, state sales tax will be applied to the Pattern subscription fee and the Afri Pearl Collections Plus subscription fee charged by Afri Pearl Collections.

VAT on Seller Fees

Depending on your business status and location, Afri Pearl Collections may be required to apply VAT on seller fees charged each month and remit it to the relevant tax authority. VAT is collected on all Afri Pearl Collections fees for sellers located in countries where VAT should be applied. To learn more about how VAT works on Afri Pearl Collections, see this Help article.

C. Taxes We Collect and Remit from Buyers on Behalf of the Seller

United States Sales Tax

In some states, Afri Pearl Collections will collect the sales tax amount from the buyer and pay this to the relevant tax authority. If the sale was made through Afri Pearl Collections Payments, the sales tax amount will appear in your payment account and is deducted from your current balance.

For items dispatched to certain states, including but not limited to Washington state (or, for digital items, those purchased with a Washington state billing address), Afri Pearl Collections will use the category you assigned to each listing to calculate, collect, and remit the applicable sales tax. For a full list of these states, please see here. Note that in those states where Afri Pearl Collections is required to collect on sales into the state made by nonresident sellers, Afri Pearl Collections will also be collecting on those sales made by resident sellers. As an example, Afri Pearl Collections will be collecting on all (taxable) purchases made in Minnesota, including those purchases made by Minnesota buyers from Minnesota sellers.

Digital VAT Fees

Under local laws in certain countries, Afri Pearl Collections is required to collect and remit VAT to the relevant tax authorities when you sell a digital item delivered via automatic download to the buyer. Afri Pearl Collections will automatically display the increased amount charged to the buyer of the digital item to collect the correct amount of VAT, and we will remit to the tax authorities. If the sales were made through Afri Pearl Collections Payments, Afri Pearl Collections will collect the VAT amount from the buyer and pay the VAT to the relevant tax authority, and you will not have to take any further action. If the sale was not made through Afri Pearl Collections Payments, you will receive the additional amount paid by the buyer for the VAT, and you will need to pay this amount to Afri Pearl Collections. The VAT amount paid by the buyer will appear on your payment account and will be deducted from your current balance.

If you are registered to use Afri Pearl Collections Payments, you may accept payment by Afri Pearl Collections Gift Cards, Afri Pearl Collections Credits, and Afri Pearl Collections Coupons. Afri Pearl Collections Gift Cards, Afri Pearl Collections Credits, and Afri Pearl Collections Coupons are subject to the Afri Pearl Collections Gift Cards, Credits & Coupons Policy. Afri Pearl Collections also charges the Afri Pearl Collections Payments payment processing fee described above on Afri Pearl Collections Gift Card, Afri Pearl Collections Credit, and Afri Pearl Collections Coupon transactions.

1. Selling Handmade Items

Handmade on Afri Pearl Collections is a spectrum. On one end, we have makers — sellers who are literally making their items with their own hands (or tools). On the other end, we have designers — sellers who design their items but rely entirely on outside assistance or another business to help physically produce them. Many handmade sellers fall in the middle of the spectrum because they are both making and designing their items.

Regardless of where you fall on this spectrum, you must be transparent about who is helping you and how your items are being made. Everything listed as handmade must be made and/or designed by you, the seller. Reselling is prohibited in the handmade category. You may also have shop members who help you run your business, as long as you, the seller, are making and/or designing your items.

Makers

A maker is a seller who is physically making the items listed for sale in their Afri Pearl Collections shop. A maker might design their items in addition to making them, or they might follow a pattern or template that they did not design. Regardless, makers must be creating their items with their own hands (or tools).

Designers

A designer is a seller who has come up with an original design, pattern, sketch, template, prototype, or plan to be produced by in-house shop members or a production partner. Simple customization, such as selecting colors, shapes, or choosing from ready-made options is not considered design on Afri Pearl Collections.

If you are a designer and you are using a production partner to help, make your items, you must also disclose information about your production partner in your listings. A production partner is anyone (who’s not a part of your Afri Pearl Collections shop) who helps you physically produce your items.

2. Using Production Assistance

Designers may work with production partners to help make handmade items in certain circumstances. Keep in mind that people come to Afri Pearl Collections to discover items that they might not find anywhere else. Your design and production process should lead to the creation of a unique item that would not exist without you, the designer.

We expect your production partner to produce items themselves in their own facilities. A contractor or agent who outsources production may not be used as a production partner. Examples of production services include, but are not limited to, printing, apparel printing, 3D-printing, casting, plating, engraving, cutting and sewing, and finishing.

If you work with a production partner, you must disclose certain information in the listing process, including:

1. The name of your production partner(s);

2. The location of your production partner(s);

3. Details about the nature of your partnership and design process; and

4. A general description of the work your production partner does for you.

You may choose to keep the name of your production partner and details about your partnership and design process confidential (visible only to select Afri Pearl Collections employees), but the location and description of your production partner will appear on your About section and listings.

We may reach out to you at any time with a more detailed enquiry about your business. Please be prepared to provide additional details about the origins of your business, your role in the design process, your production process, and your connection to your production partner, as well as what efforts your production partner has made to follow our ethical expectations.

We understand that you may wish to keep the details of your design and business practices confidential. Please be assured that Afri Pearl Collections will not use the private information you provide us for any purpose other than reviewing your business to determine that you are in compliance with our policies.

We reserve the right to reject any production partnerships that aren’t in the letter or spirit of this policy or our ethical expectations.

3. Being Transparent About Your Business

At Afri Pearl Collections, we value transparency. Transparency means that you honestly and accurately represent yourself, your items and your business. As a handmade seller, you agree to:

1. Disclose in your About section the names and roles of people who help make your items or run your business;

2. Use your own words and photographs (not stock photos) to describe your items; and

3. Respond to any enquiries from us in a timely manner. We may ask you how your items are made, what workspace, tools and equipment you use; and how you communicate and collaborate with the people who help you run your shop.

Remember: Our marketplace is built on trust. Providing false, inaccurate, or misleading information is prohibited by our Terms of Use. If we find that you’re not being open and honest with us, we may suspend or terminate your account.

Intellectual Property Policy

As a venue for artists, designers, and makers, Afri Pearl Collections takes intellectual property rights very seriously. We comply with intellectual property laws and industry best practices in order to maintain the integrity of our creative marketplace. This Intellectual Property Policy explains how we address allegations of infringement, how authorized parties can submit proper notices of infringement regarding content on our marketplace, and how Afri Pearl Collections sellers can respond when their listings or shops are affected by a notice.

1. Afri Pearl Collections’ Role

Afri Pearl Collections is a marketplace comprised of individual third-party sellers who run their own shops, create their own policies, and are responsible for their inventory, shipments, and complying with the law. We provide a venue, but Afri Pearl Collections does not manufacture goods, hold inventory, or ship items on behalf of our sellers. The content uploaded on Afri Pearl Collections’ marketplace is generated by independent sellers who are not employees, agents, or representatives of Afri Pearl Collections. Sellers are responsible for ensuring they have all necessary rights to their content and that they are not infringing or violating any third party’s rights by posting it.

Afri Pearl Collections reserves the right to disable any listing, shop, or account that we believe violates our Terms of Use, including this Intellectual Property Policy or our Prohibited Items Policy. Afri Pearl Collections also reserves the right to take action against abusers of Afri Pearl Collections’ Intellectual Property Policy or our Terms of Use.

Afri Pearl Collections can’t speak on behalf of intellectual property owners, nor is Afri Pearl Collections in a position to offer legal advice or make legal determinations whether a shop’s content infringes someone else’s intellectual property. Afri Pearl Collections will remove material cited for alleged intellectual property infringement when provided with a proper notice.

2. Notices of Intellectual Property Infringement

Afri Pearl Collections strives to respond quickly when we receive proper notice of intellectual property infringement by removing or disabling access to the allegedly infringing material. When Afri Pearl Collections removes or disables access in response to a notice, Afri Pearl Collections makes a reasonable attempt to contact the affected member, provide information about the notice and removal, and, in cases of alleged copyright infringement, provide information about how to submit a counter notice. Afri Pearl Collections may also provide a copy of the infringement notice, including the name and email address of the reporting party, to the affected member.

Please use Afri Pearl Collections’ Reporting Form to provide notice of claimed infringement to Afri Pearl Collections’ Designated Agent under the DMCA and for other intellectual property claims: www.Afri Pearl Collections.com/legal/ip/report. Using the form is the fastest way for us to address your claim.

Afri Pearl Collections may request additional information before processing a notice, such as identity verification of the reporting party or documentation regarding the claimed right. Afri Pearl Collections may reject notices or counter notices that contain information we believe is false, fraudulent, incomplete, or otherwise submitted in bad faith. Afri Pearl Collections also reserves the right to take action against abusers of this policy.

3. Counter Notice

In accordance with the Digital Millennium Copyright Act (DMCA), Afri Pearl Collections accepts counter notices for copyright notices only. When Afri Pearl Collections receives a DMCA counter notice, we will provide a copy of the counter notice to the original complaining party. The removed material may be replaced or access to it may be restored 10 business days after the counter notice is processed, unless the copyright owner files an action seeking a court order against the allegedly infringing party and informs Afri Pearl Collections of this action. 4. Repeat Infringement

Afri Pearl Collections terminates selling privileges of members who are subject to repeat or multiple notices of intellectual property infringement in appropriate circumstances and at Afri Pearl Collections’ discretion. If we believe a member has attempted to open a new shop after termination of the initial account, we reserve the right to refuse all services to that member. These actions apply to any accounts we believe are associated with or operated by the affected member. Per our Terms of Use, Afri Pearl Collections reserves the right to terminate account privileges at any time, for any reason, and without advance notice.

5. Notice Withdrawals

Afri Pearl Collections only accepts withdrawals of infringement notices directly from the intellectual property owner or authorized representative who submitted the claim. The withdrawal must clearly state that it is a formal withdrawal and sufficiently identify the member and/or material (such as by providing the username, shop name, and Afri Pearl Collections listing URLs).

Once Afri Pearl Collections receives a formal withdrawal of a notice of infringement, Afri Pearl Collections makes reasonable attempts to contact both parties involved to confirm receipt from the party submitting the withdrawal and to inform the member affected by the withdrawal. Please note that infringement matters are reviewed on a case-by-case basis, and withdrawals do not guarantee changes to a member’s shop status.

Pattern by Afri Pearl Collections allows you to grow your brand by creating a standalone website that will appear outside the Afri Pearl Collections marketplace. This Pattern Policy explains how the tool works and the rules you need to know to be successful.

1. Eligibility

You can create a Pattern site if you’re an existing Afri Pearl Collections seller and you’re registered to use Afri Pearl Collections Payments. You can turn Pattern on or off in the Pattern section of your Afri Pearl Collections Shop settings.

2. Fees

Subscription Fees

You’re welcome to try Pattern for free for 30 days. Your free trial will begin when you select ‘Start Free Trial’ from the Pattern dashboard. After 30 days, you can continue to use Pattern at the monthly subscription fee of $15.00 USD. Your first month’s statement will be prorated, based on when you signed up, and you’ll be charged the full subscription fee for each subsequent month you use Pattern. Your subscription fees will appear on your Afri Pearl Collections statement. You can learn more about your Afri Pearl Collections statement here.

Automatic Renewal

Your subscription fee will automatically renew on the first of the month at 12:01am Eastern Time (5:01am GMT). You can turn your subscription off at any time by clicking “Cancel Pattern” from the Pattern settings on your dashboard or from your payment account. If you switch off the service after your subscription renews on the first of the month, you’ll still be responsible for paying the full subscription fee for that month.

Other Fees

You will also be responsible for a payment processing fee when a buyer pays through Afri Pearl Collections Payments.

You can choose whether a listing appears only on your Pattern site or on both your Pattern site and your Afri Pearl Collections shop. Pattern-only listings (that is, listings that you only make available on your Pattern site) do not incur listing or transaction fees and never expire. You can choose to make a Pattern-only listing available in your Afri Pearl Collections shop at any time. When you list an item on both your Pattern site and your Afri Pearl Collections shop, you’ll be responsible for Afri Pearl Collections’ regular listing fee, and your listing will expire after four months.

3. Your Domain

If you already have your own domain name, you can use that for your Pattern site.

You can also register a new domain for your Pattern site on the Pattern section of your Shop settings. Through your Shop settings you’ll be able to register a new domain name through OpenSRS, which is an affiliate of our partner, Hostinger Inc., a third-party domain name registrar accredited by the Internet Corporation for Assigned Names and Numbers (ICANN). If you use this service, you will also be subject to Hostinger registration agreement and privacy policy. The cost of the registration will depend on the domain name you choose and whether you purchase WHOIS protection. The registration charges will appear on your Afri Pearl Collections statement for your convenience under “Domain registration fee”.

If you register a domain name through Open SRS, the registration will remain in effect for one year. Hostinger will send you emails reminding you to renew your registration 30 days prior to the domain expiration date, five days prior to the domain expiration date, and three days after the domain expires. For more information on the fees for domain names registered through Open SRS, please see this Help article.

Automatic Renewal

You have the option of enabling automatic renewal (which we refer to as ‘auto-renew’) for domain names you register through Open SRS. If you choose to auto-renew your domain, Open SRS will automatically extend your domain registration for an additional one-year period on each anniversary of your domain’s expiration date. If you have purchased WHOIS protection for your domain and enable auto-renew, your WHOIS protection will automatically renew each year as well. You will be charged for the domain registration fee when your domain is renewed and the registration charges will appear on your Afri Pearl Collections statement under “Domain registration fee”. You can disable auto-renew at any time through your Pattern dashboard. If your account is suspended for 30 days or longer, your domain will no longer auto-renew. You must manually renew the domain or turn auto-renew on again when your account is in good standing.

If you don’t have a domain name and don’t wish to purchase a new one, we give you the option of using your Afri Pearl Collections shop name in a domain name at no additional charge. The domain would appear like this: Your Afri Pearl Collections Shop Name. Pattern by Afri Pearl Collections.com.

Your domain name has to comply with our Terms of Use (so it can’t be offensive or infringe on someone’s intellectual property rights) and our Trademark Policy (so it may not use any trademarks owned by Afri Pearl Collections without our permission). We can’t guarantee the availability of any particular domain name. If your domain name is the subject of a legal action, you agree to indemnify and release Afri Pearl Collections from any liability.

4. Your Pattern Content

When you set up your Pattern site, your content – including your shop images, About section, Shop Policies, and listings – will be populated automatically from your existing Afri Pearl Collections shop and profile. You’ll have the opportunity to customize some Pattern content to match your unique branding. Click here to learn more.

You have the option of listing your items for sale just on your Pattern site or on both Pattern and Afri Pearl Collections. All listings, including Pattern-only listings, must comply with our Prohibited Items Policy. Items listed on both Pattern and Afri Pearl Collections must also meet the marketplace criteria outlined in Afri Pearl Collections’ Seller Policy.

You understand that you’re solely responsible for your content. You represent that you have all necessary rights to your content and that you’re not infringing or violating any third party’s rights by posting it. You also understand that you’re solely responsible for any content uploaded by visitors to your Pattern site and for removing such content from your Pattern site to the extent required by our policies or the law.

By posting your content to your Pattern site, you grant Afri Pearl Collections a license to use it. This license is just like the one you grant to Afri Pearl Collections when you post content to your Afri Pearl Collections shop. For a detailed description of the rights, you’re granting to Afri Pearl Collections and what we can do with your content, please see Section 5 of our Terms of Use. Rest assured, we don’t claim any ownership of your content; we just have your permission to display it and use it in different ways that help us promote your business and Afri Pearl Collections’.

5. Checkout

When a buyer purchases an item from your Pattern site, they’ll be directed to a checkout page on Afri Pearl Collections’ site that will highlight the name of your Pattern site. Buyers can complete the transaction by signing into their Afri Pearl Collections account, registering a new Afri Pearl Collections account, or proceeding without an Afri Pearl Collections account through Guest Checkout. 6. Legal

You are solely responsible for posting and complying with your own shop policies. We encourage you to use the shop policy tools offered by Afri Pearl Collections to provide clear information to your buyers.

You are also solely responsible for complying with any legal requirements that you may be subject to and you agree to release Afri Pearl Collections from any liability related to your use of Pattern and any domains associated with your Pattern site.

For example, in accordance with applicable laws, you may be required to post and comply with your own privacy policy for your Pattern site. See Afri Pearl Collections’ Privacy Policy for more information. If you receive a notice involving intellectual property infringement through your Pattern site, it is your responsibility to respond in accordance with the law. If Afri Pearl Collections receives a notice involving intellectual property infringement for content on your Pattern site, we will act in accordance with our Intellectual Property Policy.

We reserve the right to remove any content from your Pattern site or to prevent you from using Pattern entirely, if your site violates any of Afri Pearl Collections’ policies or if we’re required to do so for legal reasons.

We believe in transparency, and we’re committed to being upfront about our privacy practices, including how we treat your personal information. We know you care about your privacy too, so we provide settings that allow you to choose how certain information is used by Afri Pearl Collections. We process your personal information to run our business and provide our users with the Services. By accepting our Terms of Use (and in some jurisdictions, by acknowledging this policy), you confirm that you have read and understand this policy, including how and why we use your information. If you don’t want us to collect or process your personal information in the ways described in this policy, you shouldn’t use the Services. We are not responsible for the content or the privacy policies or practices of any of our members, websites hosted through Pattern by Afri Pearl Collections, or third-party websites and apps.

Afri Pearl Collections’ Terms of Use require all account owners to be at least 18 years of age. Minors under 18 years of age and at least 13 years of age are permitted to use Afri Pearl Collections’ Services only if they have permission and direct supervision by the owner of the account. Children under age 13 are not permitted to use the Services. You are responsible for any and all account activity conducted by a minor on your account. We do not knowingly “sell”, as that term is defined under applicable law, including the California Consumer Privacy Act, the personal information of minors. By using the Services, you acknowledge that Afri Pearl Collections will use your information in Uganda, the United States, Ireland and any other country where Afri Pearl Collections operates. Please be aware that the privacy laws and standards in certain countries, including the rights of authorities to access your personal information, may differ from those that apply in the country in which you reside. We will transfer personal information only to those countries to which we are permitted by law to transfer personal information as more fully described in the “Transfers” Section of this policy.

2. Information Collected or Received

In the course of providing our Services, we collect or receive your personal information in a few different ways. We obtain the categories of personal information listed below from the following sources: directly from you, for example, from forms you complete or during registration; indirectly from you based on your activity and interaction with our Services, or from the device or browser you use to access the Services; from our vendors and suppliers that help provide Afri Pearl Collections services you may interact with (such as, for example, for payments or customer support), and from our third party advertising and marketing partners. Often, you choose what information to provide, but sometimes we require certain information to provide you the Services. Afri Pearl Collections uses the personal information it receives and collects in accordance with the purposes described in this policy.

You can also choose to provide information to a third party via Afri Pearl Collections’ API. While users of Afri Pearl Collections’ API are required to follow Afri Pearl Collections’ API Terms of Use, including having appropriate privacy and security controls, Afri Pearl Collections does not have a direct partner relationship with these third parties and their processing of information is subject to their own privacy policies. You should understand the privacy and security practices of any third party before you share information with them.

Registration, Account Setup, Service Usage: In order to use the Services, you will need to submit a valid email address. If you register, you will need to submit a name associated with your account. You may modify that name through your account settings. You need to provide this information to enable us to provide you with the Services. Additional information, such as a shop name, billing and payment information (including billing contact name, address, telephone number, credit card information), a telephone number, and/or a physical postal address, may be necessary in order for us to provide a particular service. For example, we need a physical postal address if you are buying something on the Site for delivery. As an Afri Pearl Collections seller, if you choose to use our payment service (“Afri Pearl Collections Payments”), Afri Pearl Collections requires your full name, social security number, identification ID or tax ID, date of birth, bank account information, photograph, credit card information, and/or other proof of identification in order to verify your identity, provide this service to you, and comply with applicable law. For example, in certain markets, Afri Pearl Collections Sellers’ imprint (including trade name or individual name as applicable), may be displayed to buyers on Afri Pearl Collections in order to comply with local legal requirements. For both buyers and sellers, Afri Pearl Collections requires this information from you in order to provide you with the Services (including, to verify ownership of an account, to mitigate fraud and abuse, to comply with regulatory obligations, or to complete a transaction as a buyer or seller). We may store credit card information and other information provided to us during checkout, for billing and payment purposes, and to process your transaction. Members in certain countries can elect to save their credit card information to facilitate checkout for future purchases. If you’re an Afri Pearl Collections buyer in the EU, Norway, Iceland, or Liechtenstein, you may be asked to authenticate your payment method when you place your order. To authenticate a payment, you will need to respond to a prompt from your card issuer and provide additional information, such as a correct response to a question, a password, or a passcode. Afri Pearl Collections may contact individual shop owners confidentially to request more information about their shops or items listed through the Services, or may request information from buyers to ensure compliance with our policies and applicable law. In order to use certain products or services on Afri Pearl Collections, you may be required to complete an application; information that you submit through the application process will not be displayed publicly and will only be used internally by Afri Pearl Collections and its service providers, unless otherwise specified.

Profile: You may provide your name and other personal information (such as birthday, gender, location) in connection with your account and activity. You can edit or remove this information through your account settings. The name associated with your account (which you may modify in your account settings) is publicly displayed and connected to your Afri Pearl Collections activity. Other members may see the date you joined; ratings, reviews and information relating to items you review, and related photos for items you purchased or sold; your profile information; items you listed for sale; your shop pages and policies; your Favorites, followers, and those you follow; sold item listings and the number of items sold; comments you post in our community spaces; and information you decide to share via social networks. For Sellers, we may collect and use information about you in order to feature you in marketing and advocacy materials, and to feature you and your shop on and off the platform, as provided for in Afri Pearl Collections’ Terms of Use. From time to time, we may also ask you about certain demographic information, such as your race, ethnicity, sexual orientation, or gender identity, in relation to specific marketing and advocacy projects and campaigns. Providing this demographic information is entirely voluntary and at the time we ask we will also seek your consent to use it.

Automated Information: Afri Pearl Collections automatically receives and records information from your browser or your mobile device when you visit the Site, use the Apps, or use certain features of the Services, such as your IP address or unique device identifier, cookies, and data about which pages you visit and how you interact with those pages in order to allow us to operate and provide the Services. This information is stored in log files and is collected automatically. Afri Pearl Collections may also receive similar information (like, for example, IP addresses and actions taken on the device) provided by a connected Internet of Things device such as a voice-activated assistant or Smart TV. We may combine this information from your browser or your mobile device with other information that we or our advertising or marketing partners collect about you, including across devices. This information is used to prevent fraud and to keep the Services secure, to analyze and understand how the Services work for members and visitors, and to provide advertising, including across your devices, and a more personalized experience for members and visitors.

We also automatically collect device-specific information when you install, access, or use our Services. This information can include information such as the hardware model, operating system information, app version, app usage and debugging information, browser information, IP address, and device identifiers. Data from Afri Pearl Collections Vendors and Suppliers: We also receive information from our vendors and suppliers about you. This information can include customer service interactions, payments information, delivery information, and information shared in Afri Pearl Collections’ forums.

Data from Advertising and Marketing Partners: As described below, Afri Pearl Collections receives information from our advertising and marketing partners about you. This information can include attribution information via cookies and UTM tags in URLs to determine where a visit to Afri Pearl Collections comes from, responses to marketing emails and advertisements, responses to offers, and audience information from partners who you have given consent to share that information with us.

Location Information: We collect information about your use of the Services for advertising, for analytics, to serve content, and to protect the Services. This can include your IP address, browser information (including referrers), device information (such as iOS IDFA, IDFV for limited non-advertising purposes, Android AAID, and, when enabled by you, location information provided by your device). When you use the Apps, you can choose to share your geolocation details with Afri Pearl Collections in order to use functions like our local marketplace, maps, and for in-person sales (although you don’t need to share these details). You can choose to publish your location when you sell on Afri Pearl Collections.

We obtain location information you provide in your profile or your IP address. With your consent, we may also determine location by using other information from your device, such as precise location information from GPS or information about wireless networks or cell towers near your mobile device. We use and store information about your location to provide features and to improve and customize the Services, for example, for Afri Pearl Collections’ internal analytics and performance monitoring; localization, regional requirements, and policies for the Services; for local content, search results, and recommendations; for delivery and mapping services; and (using non-precise location information) marketing. If you have consented to share your precise device location details but would no longer like to continue sharing that information with us, you may revoke your consent to the sharing of that information through the settings on the Apps or on your mobile device. Certain non-precise location services, such as for security and localized policies based on your IP address or submitted address, are critical for the Site to function. We will only share your geolocation details with third parties (like our mapping, payments, or, to the extent applicable, advertising providers) in order to provide you with the Services. You may also choose to enable the Apps to access your mobile device’s camera to upload photographs to Afri Pearl Collections.

Analytics Information: We use data analytics software to ensure Site and App functionality and to improve the Services. This software records information such as how often you use the Apps, what happens within the Apps, aggregated usage, performance data, app errors and debugging information, and where the Apps were downloaded from. We do not link the information we store within the analytics software to any personally identifiable information that you submit within the mobile application. Information from Third Parties: Some members or visitors may choose to connect to Afri Pearl Collections or register an Afri Pearl Collections account using an external third-party application, such as Facebook, or an app developed using Afri Pearl Collections’ API. Connecting your Afri Pearl Collections account to third-party applications or services is optional. If you choose to connect your account to a third-party application, it is subject to your agreements with that third party (like their Terms of Use and privacy notices), and Afri Pearl Collections can receive information from that application. We may also collect public information in order to connect with you, such as when we communicate with you over social media. We may use that information as part of providing the Services to you. You can also choose to share some of your activity on Afri Pearl Collections on certain social media networks which are connected to your Afri Pearl Collections account, and you can revoke your permission anytime in your account settings. Certain third-party applications that you use to create or sign in to your account may provide you with the option to discontinue receiving messages from us or allows you to forward those messages to another email address. If we are unable to send you critical messages about your account, we may suspend or terminate your account.

Non-Member Information: Afri Pearl Collections receives or obtains information (for example, an email address or IP address) about a person who is not yet a registered Afri Pearl Collections member (a “non-member”) in connection with certain Afri Pearl Collections features, such as when a non-member chooses to subscribe to an Afri Pearl Collections newsletter, a member invites a non-member to visit the Site, a member uploads non-member information using the contact uploader feature, a non-member engages in a transaction, a member sends a gift card code to a non-member, or a non-member uses Guest Checkout to make a purchase. Non-member information is used only for the purposes disclosed when it was submitted to Afri Pearl Collections, for purposes necessary to the functioning of Afri Pearl Collections’ Services or where Afri Pearl Collections has a legitimate interest, as disclosed in the “Information Uses, Sharing, & Disclosure” Section below, or to facilitate action authorized by a member or the non-member.

Pattern by Afri Pearl Collections: We also collect certain information from both members and non-members who visit websites hosted by us. This information may include your IP address or unique device identifier, and cookies and data from the pages you visit. For more information on our use of cookies and collection of tracking information, see our Cookies & Similar Technologies Policy or “Information Uses, Sharing, & Disclosure” section below.

3. Findability

You can choose to import your contacts from your mobile device or personal email address book, or a social network account to Afri Pearl Collections. We do not retain the login information for your email service, mobile device, or social network site. You can search for people you know by email address or phone number on the Site or through the contact information you import. Finding your friends on Afri Pearl Collections helps you connect with them on our platform. For example, you can follow another member’s public activity, such as public Favorites. When you begin following another member’s activity, they will receive an email notification (if the member has consented to receiving this type of email).

If you do not want your contacts to be able to find you on Afri Pearl Collections through your email address, phone number, or social networking connections, then you can change your findability through your account settings. If you do not wish to be located on Afri Pearl Collections via your name, you can remove your name and instead may use a nickname or alias as your name in your public account information.

4. Messages from Afri Pearl Collections

On occasion, Afri Pearl Collections will need to contact you. Primarily, these messages are delivered by email, Afri Pearl Collections Messages, or by push notifications for a variety of reasons, including marketing, transactions, advocacy, and service update purposes. If you no longer wish to receive push notifications, you can disable them at device level. You can opt out of receiving marketing communications via email or Messages in your account settings or by following the unsubscribe link in any marketing email you receive. To ensure you properly receive notifications, we will need to collect certain information about your device, such as operating system and user identification information. Every account is required to keep a valid email address on file to receive messages. Afri Pearl Collections may also contact you by telephone to provide member support or for transaction-related purposes if you request that we call you. Additionally, and with your consent where required by applicable law, Afri Pearl Collections may send you an SMS (or similar) message, or reach out to you by telephone, in order to provide you with customer support, for research or feedback, or to provide you with information about products and features that you may find of interest. You can update your contact preferences in your account settings.

Some messages from Afri Pearl Collections are service-related and necessary for members and Guest Checkout users. You understand and agree that Afri Pearl Collections can send you non-marketing emails, Afri Pearl Collections Messages, or messages, such as those related to transactions, your account, security, or product changes. Examples of service-related messages include an email address confirmation/welcome email when you register your account, notification of an order, service availability, modification of key features or functions, relaying Messages with buyers, and correspondence with Afri Pearl Collections’ Support team (including by chat interface or the other methods of communication as described above).

When you register for an account, subscribe to a newsletter, or provide us with your email address or phone number such as for a Guest Checkout purchase, you receive notice of and agree (in some jurisdictions and situations, by an additional unambiguous consent) to receive marketing emails and messages from us. You can unsubscribe at any time from marketing emails or messages through the opt-out link included in marketing emails or messages. Members can also control which marketing emails or messages they receive from Afri Pearl Collections through their account settings. Please note that some changes to your account settings may take a few days to take effect.

A contact-importer feature is available to help you locate and connect with your friends and contacts who may be members of Afri Pearl Collections (see the “Findability” section above for more information). If someone in your contact list is not already a member, you may invite them to join Afri Pearl Collections, and an email will be sent to them on your behalf. Recipients of email invitations may opt out of receiving future invitations by following instructions in the email invitation message. You may send an invitation only to someone who has given you consent to receive one.

5. Community

Afri Pearl Collections is a marketplace and a community. We offer several features that allow members to connect and communicate in public or semi-public spaces, such as Forums and Teams, which are a part of the Afri Pearl Collections Community space. You don’t have to use these features, but if you do, please use common sense and good judgment when posting in these community spaces or sharing your personal information with others through the Services. Be aware that any personal information that you choose to submit there can be read, collected, or used by others, or could be used to send unsolicited messages to you. We engage certain third parties to assist in providing community services to you and, in the context of that relationship, we need to share some of your information with such third parties in order to provide that service. This may include, for example, information from your Afri Pearl Collections account that is publicly available, your account’s status, your forum posts and Team memberships, your Afri Pearl Collections username and/or shop name, the display name you’ve optionally chosen to share publicly in your Afri Pearl Collections account, avatar image, the date that you registered on Afri Pearl Collections, as well as your language and regional settings on the Site. If you close your Afri Pearl Collections account, your community account, which allows you to post in Forums, will also be closed and related personal information will be deleted. However, your posts may remain public after your account is closed, although your name will no longer be displayed alongside the post. You are responsible for the personal information that you choose to post in community spaces through the Services. You can set your privacy preferences and download your data in your Community Settings, and close or delete your community account by submitting a request to Afri Pearl Collections.

Another member may follow your public activity on the Site to receive updates, such as when you add an item to your public Favorites. You may choose to make certain activities private through your account settings. You have the option to block any member with whom you do not wish to share your updates.

6. Information Uses, Sharing, & Disclosure

We respect your privacy. Afri Pearl Collections will not disclose your name, email address or other personal information to third parties without your consent, except as specified in this policy.

You can control your privacy settings through the opt-out buttons in your account settings privacy tab, and the Privacy Settings link in the footer of most site pages and our homepage. Please note that some changes to your privacy settings may take a few days to take effect. We or our sellers may advertise our Services or our sellers’ products through a variety of different mediums and rely on your consent to do so off-site.

Legal Bases

When you access or use the Services, we collect, use, share, and otherwise process your personal information for the purposes described in this policy. We rely on a number of legal bases to use your information in these ways. These legal bases include where:

• Necessary to perform the contractual obligations in our Terms of Use and in order to provide the Services to you;

• You have consented to the processing, which you can revoke at any time;

• Necessary to comply with a legal or regulatory obligation, a court order, or to exercise or defend any impending or asserted legal claims;

• Necessary for the purposes of our or a third party’s legitimate interests, such as those of visitors, members, or partners (described in more detail below);

• You have expressly made the information public;

• Necessary in the public interest, such as to prevent crime; and

• Occasionally necessary to protect your vital interests or those of others (in rare cases where we may need to share information to prevent loss of life or personal injury).

We principally rely on consent (which can be withdrawn at any time) (i) to send marketing messages, (ii) for third-party data sharing related to advertising, and, to the extent applicable, (iii) for the use of location data for advertising purposes.

We rely on consent for targeted online and offline marketing including through tools like Facebook Custom Audience and Google Customer Match. We or our sellers may advertise our Services or our sellers’ products through a variety of different mediums and rely on your consent to do so off-site. As part of this, we may work with advertising partners such as Facebook, Google, and other partners disclosed in our Cookies and Similar Technology Policy. These partners have their own privacy policies and consent mechanisms for their customers, in addition to Afri Pearl Collections’ controls. You may see the privacy policies and privacy choices for these partners, and the information you share with them, in our Cookies and Similar Technology Disclosures.

Afri Pearl Collections may also use first party data (e.g. your prior shopping and browsing patterns on our Site), and may combine it with other data collected from you, such as your location, or publicly available information, to permit us to create targeted audiences based on your known or inferred demographic and/or interests to provide you with more relevant and useful advertising on our site, in our direct marketing channels (like email), or with our off site marketing partners, like Google and Facebook, subject to their terms and privacy notice you agreed to with such partners .

Our Legitimate Interests

Where we process your information on the basis of legitimate interests, we do so as follows:

Providing and Improving our Services: We use your information to improve and customize our Services, including sharing your information for such purposes, and we do so as it is necessary to pursue our legitimate interests of improving our Services for our users. This is also necessary to enable us to pursue our legitimate interests in understanding how our Services are being used, and to explore and unlock ways to develop and grow our business. It is also necessary to allow us to pursue our legitimate interests in improving our Services, efficiency, interest in Services for users, and obtaining insights into usage patterns of our Services. As a core part of our Services, we have a legitimate interest in customizing your on-site experience to help you search for and discover relevant items and recommended purchases, including using this information to help sellers find the best ways to market and sell their products on Afri Pearl Collections.

Providing Marketing Communications: We rely on our legitimate interest to send you marketing messages (where permitted independent of consent) and for Afri Pearl Collections’ advertising programmes (including Afri Pearl Collections’ on-site advertising and marketing).

Keeping our Services Safe and Secure: We use your information for safety and security purposes, which can include sharing your information for such purposes, and we do so because it is necessary to pursue our legitimate interests or those of a third party in ensuring the security of our Services, preventing harm to individuals or property, or crime, enforcing or defending legal rights, or preventing damage to Afri Pearl Collections’ systems, or those of our users or our partners. This includes enhancing protection of our community against spam, harassment, intellectual property infringement, crime, and security risks of all kinds. We use your information to provide and improve the Services, for billing and payments, for identification and authentication, and for general research and aggregate reporting. For example, in accordance with our existing case resolution process, we may use information you provide to resolve disputes with Afri Pearl Collections or other members.

Buying and Selling: As part of the buying and selling process, Afri Pearl Collections will facilitate the sharing of information between the two members involved in the transaction, such as the other Afri Pearl Collections member’s delivery address and payment status. This can also involve us sharing your information with some of our third-party partners such as our delivery and payment partners to enable us to provide the Service to you. Such partners will process your personal information in accordance with their own privacy policies. In some instances, while they are subject to Afri Pearl Collections’ privacy and security requirements for vendors, these partners, not Afri Pearl Collections, are responsible for the protection of personal information under their control. By making a sale or a purchase on Afri Pearl Collections, you are directing us to share your information in this way. Since this is an important part of the Services we provide, we need to do this in order to perform our obligations under our Terms of Use. We expect you to respect the privacy of the member whose information you have received. As described in Afri Pearl Collections’ Terms of Use, you have a limited license to use that information only for Afri Pearl Collections-related communications or for Afri Pearl Collections-facilitated transactions. Afri Pearl Collections has not granted a license to you to use the information for unauthorized transactions or sending unsolicited commercial messages in violation of any applicable laws, including any consent requirements of the jurisdiction of the recipient. You should only add a member to your email or physical mailing list or otherwise use or store a member’s personal information in accordance with applicable laws, including any consent requirements that apply in that member’s jurisdiction.

Site Customization: We may learn about the types of products that you’re interested in from your browsing and purchasing behavior on (and off) the Site or Apps and use such information to suggest potential purchases as a result. As a core part of our Services, we have a legitimate interest in customizing your on-site experience to help you search for and discover relevant items and recommended purchases, including using this information to help sellers find the best ways to market and sell their products on Afri Pearl Collections.

Legal and Safety: Afri Pearl Collections may also retain, preserve, or release your personal information to a third party in the following limited circumstances: in response to lawful requests by public authorities, including to meet legitimate national security or law enforcement requirements; to protect, establish, or exercise our legal rights or defend against impending or asserted legal claims, including to collect a debt, or a material violation of our policies (including our Intellectual Property Policy); to comply with a subpoena, court order, legal process, regulation, or other legal requirement; or when we believe in good faith that such disclosure is reasonably necessary to comply with the law, prevent imminent physical harm or financial loss, or investigate, prevent, or take action regarding illegal activities, suspected fraud, threats to our rights or property, or violations of Afri Pearl Collections’ Terms of Use. For example, if permitted due to the forgoing circumstances, your information may be shared with tax authorities or other governmental agencies. In the cases set out above, our use of your information may be necessary for the purposes of our or a third party’s legitimate interest in keeping our Services secure, preventing harm or crime, enforcing or defending legal rights, or preventing damage. Such use may also be necessary to comply with a legal obligation, a court order, or to exercise or defend legal claims or to facilitate the collection of taxes and prevention of tax fraud. It may also be necessary in the public interest (such as to prevent crime) or to protect vital interests (in rare cases where we may need to share information to prevent loss of life or personal injury).

If Afri Pearl Collections receives a lawful, verified request for a member’s records or information in one of the limited circumstances described in the previous paragraph, Afri Pearl Collections may disclose personal information, which may include, but may not be limited to, a member’s name, address, phone number, email address, company/trading name and, where appropriate, bank account and transaction details. Affiliated Businesses: Afri Pearl Collections is affiliated with a variety of businesses and works closely with them for a variety of purposes, including assisting us to perform and improve the Services. These businesses may sell items or services to you through the Services or, with your consent, offer promotions (including email promotions) to you. Afri Pearl Collections also provides services or sells products jointly with affiliated businesses, including providing you with the opportunity to sign up with such partners and allow them to more effectively market to you. When an affiliated business assists in facilitating your transaction, we may need to share information related to the transaction with that affiliated business in order to facilitate your transaction, and this forms part of the Services we provide in accordance with our Terms of Use. We rely on consent (which can be withdrawn at any time) to send marketing messages and for third-party sharing relating to advertising. As part of this, we may work with advertising partners such as Facebook or Google and we may use analytics aggregated from usage information including, for example, search keywords, favorites, browsing history and purchase history.

Aggregated Information: Afri Pearl Collections may share demographic information with business partners, but it will be aggregated and de-personalized so that personal information is not revealed.

Service Providers: Afri Pearl Collections also needs to engage third-party companies and individuals (such as research companies, and analytics and security providers) to help us operate, provide, and market the Services. These third parties have only limited access to your information, may use your information only to perform these tasks on our behalf, and are obligated to Afri Pearl Collections not to disclose or use your information for other purposes. Our engagement of service providers is often necessary for us to provide the Services to you, particularly where such companies play important roles like helping us keep our Service operating and secure. In some other cases, these service providers aren’t strictly necessary for us to provide the Services, but help us make it better, like by helping us conduct research into how we could better serve our users. In these latter cases, we have a legitimate interest in working with service providers to make our Services better.

Business Reorganization: In some cases, Afri Pearl Collections may choose to buy or sell assets. Such transactions may be necessary and in our legitimate interests, particularly our interest in making decisions that enable our business to develop over the long term. In these types of transactions (such as a sale, merger, liquidation, receivership, or transfer of all or substantially all of Afri Pearl Collections’ assets), member information is typically one of the business assets that is transferred. If Afri Pearl Collections intends to transfer information about you, Afri Pearl Collections will notify you by email or by putting a prominent notice on the Site and the App, and you will be afforded an opportunity to opt out before information about you becomes subject to a different privacy policy.

Third Parties: Third-party plug-ins also collect information about your use of the Site. For example, when you load a page on Afri Pearl Collections that has a social plug-in from a third-party site or service, such as a “Like” or “Send” button, you are also loading content from that third-party site. That site may request cookies directly from your browser. These interactions are subject to the privacy policy of the third-party site. In addition, certain cookies and other similar technologies on the Site are used by third parties for targeted online marketing and other purposes. These technologies allow a partner to recognize your computer or mobile device each time you use the Services. Please be aware that when you use third-party sites or services, their own terms and privacy policies will govern your use of those sites or services. Afri Pearl Collections chooses and manages these third-party technologies placed on its Sites and Apps. We rely on your consent to drop and read these cookies when not technically necessary or when not required based on another purpose such as legitimate interest.

This policy does not apply to the practices of third parties (such as other members who sell using the Services, certain third-party providers on whom we rely to provide certain services, or API users) that Afri Pearl Collections does not own or control or individuals that Afri Pearl Collections does not employ or manage, except as otherwise provided for in the Terms or as required by law. If you provide your information to such third parties in connection with your use of the Services, different practices may apply to the use or disclosure of the information that you provide to them. While Afri Pearl Collections requires these third parties to follow Afri Pearl Collections’ privacy and security requirements, Afri Pearl Collections does not control the privacy or security policies of such third parties. To the full extent applicable in your jurisdiction, Afri Pearl Collections is not responsible for the privacy or security practices of these sellers, API users, or other websites on the internet, even those linked to or from the Services. We encourage you to read the privacy policies and ask questions of third parties before you disclose your personal information to them. For the purposes of European law, these sellers, third party providers, and API users are independent controllers of data, which means that they are responsible for providing and complying with their own policies relating to any personal information they obtain in connection with the Services.

7. Transfers

Afri Pearl Collections operates a global service. If you reside outside of North or South America, your personal information is controlled by Afri Pearl Collections Ireland UC. By using our Services, you understand that Afri Pearl Collections Ireland UC may share some of the information it gathers with Afri Pearl Collections, Inc. (its US parent company) or other Afri Pearl Collections affiliates for purposes described in this privacy policy, including for ID verification, transaction reviews, and payment processing.

The United States, European Economic Area (“EEA”) Member States, and other countries all have different laws. When your information is moved from your home country to another country, the laws and rules that protect your personal information in the country to which your information is transferred may be different from those in the country in which you live. For example, the circumstances in which law enforcement can access personal information may vary from country to country. In particular, if your information is in the US, it may be accessed by government authorities in accordance with US law.

To the extent that Afri Pearl Collections is deemed to transfer personal information outside of the EEA, we rely separately, alternatively, and independently on the following legal bases to transfer your information:

Model Clauses

The European Commission has adopted standard contractual clauses (also known as Model Clauses), which provide safeguards for personal information that is transferred outside of Europe. We often use these Model Clauses when transferring personal information outside of Europe. You can request a copy of our Model Clauses by contacting us.

Necessary for the Performance of the Contract between Afri Pearl Collections and its Members

Afri Pearl Collections provides a voluntary service; you can choose whether or not to use the Services. As we operate in countries worldwide and use technical infrastructure in Uganda and U.S. to deliver the Services to you, in accordance with the contract between us (our Terms of Use), we need to transfer your personal information to the U.S. and to other jurisdictions as necessary to provide the Services. Simply put, we can’t provide you with the Services and perform our contract with you without moving your personal information around the world. 

8. Security

The security of your personal information is important to us. We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and after it is received, for example encryption is used for certain information (such as credit card numbers) using TLS (transport layer security). Unfortunately, no method of transmission over the internet or method of electronic storage is 100% secure. Therefore, while we strive to protect your personal information, we can’t guarantee its absolute security.

Your account information is protected by a password. It is important that you protect against unauthorized access to your account and information by choosing your password carefully and by keeping your password and computer secure, such as by signing out after using the Services. Afri Pearl Collections offers advanced security features and settings for members, such as two-factor authentication for signing in, and sign in history and notifications; you can view more information in your account settings.

9. Retention

Afri Pearl Collections will retain your information only for as long as is necessary for the purposes set out in this policy, for as long as your account is active (i.e., for the lifetime of your Afri Pearl Collections member account), or as needed to provide the Services to you. If you no longer want Afri Pearl Collections to use your information to provide the Services to you, you may close your account. Afri Pearl Collections will retain and use your information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your information to comply with applicable tax/revenue laws), resolve disputes, enforce our agreements, and as otherwise described in this policy. In addition, Afri Pearl Collections sellers may also be required to retain and use your information in order to comply with their own legal obligations. Please note that closing your account may not free up your email address, username, or shop name (if any) for reuse on a new account. We also retain log files for internal analysis purposes. These log files are generally retained for a brief period of time, except in cases where they are used for site safety and security, to improve site functionality, or we are legally obligated to retain them for longer time periods.

10. Your Rights & Choices

Certain privacy laws around the world, including the European General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA), provide users with rights related to their personal information. Consistent with those laws, Afri Pearl Collections gives you the choice of accessing, editing, or removing certain information, as well as choices about how we contact you. You may change or correct your Afri Pearl Collections account information through your account settings. You may also remove certain optional information that you no longer wish to be publicly visible through the Services, such as your name. You can also request to permanently close your account and delete your personal information. Depending on your location, you may also benefit from a number of rights with respect to your information. While some of these rights apply generally, certain rights apply in limited cases.

• Right to Access & Portability: You can access certain personal information associated with your account by visiting your account privacy settings. You can request a copy of your personal information in an easily accessible format and information explaining how that information is used. See this Help Centre article for more information.

• Right to Correction: You have the right to request that we rectify inaccurate information about you. By visiting your account settings, you can correct and change certain personal information associated with your account.

• Right to Restrict Processing: In certain cases where we process your information, you may also have the right to restrict or limit the ways in which we use your personal information.

• Right to Deletion: In certain circumstances, you have the right to request the deletion of your personal information, except information we are required to retain by law, regulation, or to protect the safety, security, and integrity of Afri Pearl Collections. See this Help Centre article for more information.

• Right to Object: If we process your information based on our legitimate interests as explained above, or in the public interest, you can object to this processing in certain circumstances. In such cases, we will cease processing your information unless we have compelling legitimate grounds to continue processing or where it is needed for legal reasons. Where we use your personal data for direct marketing purposes, you can object using the unsubscribe link in such communications or changing your account email settings.

Prohibited Items Policy

Afri Pearl Collections is not a curated marketplace. However, for a variety of reasons, we prohibit certain types of items from Afri Pearl Collections. Some items present legal risks to our community; others are inconsistent with our values, are harmful to our members, or simply are not in the spirit of Afri Pearl Collections. This policy explains what is prohibited or restricted on Afri Pearl Collections.

We have a zero-tolerance policy for prohibited items, particularly those that promote, support or glorify hatred, those that promote, support or glorify violence, or are unlawful. Sellers deemed to violate this policy can be subject to immediate account suspension or termination, in accordance with our Terms of Use.

This policy is a part of our Terms of Use. By opening an Afri Pearl Collections shop, you’re agreeing to this policy and our Terms of Use.

Policy decisions are complex. We consider many different and often divergent factors before coming to a decision about what is best for our community. Because we are a creative community, we err on the side of freedom of expression. We also tend to allow items that have educational, historical or artistic value, but we know that even those items are subject to a variety of valid and sometimes conflicting interpretations and emotional responses.

Art and history can be provocative, emotional and divisive. There are some topics on which we may never reach a consensus as a community, and that is okay. In the words of Joyce Carol Oates, ‘art should not be comforting; for comfort, we have mass entertainment and one another. Art should provoke, disturb, arouse our emotions, expand our sympathies in directions we may not anticipate and may not even wish.’

In order to help provide clarity and insight into our policy making process, we have included the rationale behind our decisions and details about how they will be enforced, including some representative examples below of what is allowed on Afri Pearl Collections. We reserve the right to remove listings that we determine are not within the spirit of Afri Pearl Collections. Violating this policy may result in the member’s selling privileges being suspended and/or terminated.

1. Alcohol, Tobacco, Drugs, Drug Paraphernalia, and Medical Drugs

Alcohol and drugs are prohibited on Afri Pearl Collections. These substances face serious legal restrictions and in many cases are considered controlled substances under applicable law. Our policy also applies to other substances that have or are claimed to have an intoxicating or healing effect. Possible legal restrictions aside, these substances are not in the spirit of Afri Pearl Collections.

The following are examples of items that may not be sold on Afri Pearl Collections:

1. Alcohol.

2. Tobacco products, smokable products, e-cigarettes and e-liquid.

3. Drugs and certain herbal substances, including substances used for recreational and medicinal purposes, regardless of their legality.

4. Drug paraphernalia, including, for example: items with a carburetor; slides and/or items with a slide; bongs and bubblers; vaporisers and their components.

5. Medical drugs, regulated medical devices, and pharmaceuticals.

Restrictions on descriptions of purported health benefits:

A medical drug claim is statement or suggestion that an item prevents, heals, or treats a medical condition or disease. Medical drug claims are subject to varying degrees of regulation. If you make claims about the purported health benefits of an item for sale on Afri Pearl Collections, we urge you to speak with a qualified expert about which regulations apply to you. It is your responsibility to know and comply with all laws and regulations that apply to the items you sell.

Afri Pearl Collections prohibits certain medical drug claims based on our values, such as claims likely to deceive or pose an unreasonable risk to our community. Afri Pearl Collections may remove claims that we deem to be inappropriate, excessive, or otherwise unsuitable for our marketplace. We also remove content that promotes prohibited medical claims, such as anti-vaccine items. If Afri Pearl Collections receives proper notice from a legal authority, we may remove an item. 2. Animal Products and Human Remains

Certain animal products are highly regulated and prohibited on Afri Pearl Collections due to the risk of harm to live, companion, or endangered animals.

The following are examples of animal products that may not be sold on Afri Pearl Collections:

  1. Live animals.
  2. Items created using any endangered or threatened animal species. We define these as animal species designated as threatened or endangered by the US Endangered Species Act or listed in Appendix I of the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES).   3. Items made from cat and dog parts or pelts as defined by Uganda and US Federal Law.
  4. Ivory or bones from ivory-producing animals, including tusks, elk ivory, fossilised ivory and woolly mammoth ivory.
  5. Items made from human remains or products from the human body, except for teeth, fingernails, and hair.

We expect all of our members to follow their local laws. If you are delivering items across international borders, you should also consult CITES for specific information about importing and exporting species that may be threatened. If you sell products containing feathers, you should also consult the Migratory Bird Treaty Act.

3. Dangerous Items: Hazardous Materials, Recalled Items and Weapons

For safety and legal reasons, we prohibit certain dangerous items from our marketplace.

Hazardous Materials

Due to the potential harm caused by hazardous materials, as well as complex legal and delivery regulations surrounding such materials, hazardous materials are prohibited on Afri Pearl Collections.

While not exhaustive, the following materials are examples of prohibited hazardous materials:

  1. Explosives (fireworks or sparklers)
  2. Explosive precursors
  3. Flammable items
  4. Gases
  5. Radioactive material
  6. Toxic substances (such as poisons)

Recalled Items or Items that Present Unreasonable Risk of Harm

Items that have been recalled by governments or manufacturers are prohibited from being sold on Afri Pearl Collections. A few examples of items that have been recalled are certain vintage Corning Ware percolators, lawn darts and drop side cribs.

Items that present an unreasonable risk of harm are prohibited, even if they have not been the subject of a recall. This would include, for example, items that present a choking hazard. We generally rely on information from various government agencies to identify these items.

Weapons

Context matters when it comes to defining what is or is not a weapon. When in doubt, it’s safe to assume that we won’t allow any item intended to be used as a weapon to inflict harm. The following items are generally not allowed on Afri Pearl Collections:

1. Guns, knives, or other blatant weapons, even if they are vintage. See here for more information.

2. Imitation firearms and weapons that look real or are prohibited by Uganda and US law

4. Hate Items: Items that Promote, Support or Glorify Hatred

We want Afri Pearl Collections to be a community where people of all backgrounds, nationalities, religions, political affiliations and even different types of artistic taste and humour feel welcome. Art is incredibly subjective, and what is offensive to one is not necessarily offensive to others.

Afri Pearl Collections does not allow items or listings that promote, support or glorify hatred towards people or otherwise demean people based upon: race, ethnicity, national origin, religion, gender, gender identity, disability, or sexual orientation (collectively, “protected groups”). We also prohibit items or content that promote organizations or people with such views.

The following items are not allowed on Afri Pearl Collections:

  1. Items that support or commemorate current or historical hate groups, including propaganda or collectibles. Examples of hate groups include Nazi or Neo-Nazi groups, Ku Klux Klan (KKK) groups, white supremacist groups, misogynist groups, or groups that advocate anti-gay, anti-immigrant, or Holocaust denial agendas.
  2. Items that contain racial slurs or derogatory terms in reference to protected groups.

Examples of What is Allowed:

Some items may contain symbols or terms associated with hate groups in a context unrelated to the group itself. We understand that these items are subject to a variety of valid and often conflicting interpretations of their educational, historical and artistic value. Recognizing that there may be no consensus on their value and reserving the right to evaluate such items on an individual, case-by-case basis, the following types of items are generally allowed on Afri Pearl Collections:

Co-opted symbols, such as the swastika, when used in peaceful or religious context (often in Hinduism, Buddhism, and Jainism). The item itself must possess features that clearly depict its cultural or religious origin or purpose.

A note on swastikas:

We are sensitive to the fact that there are many cultures throughout the world which use the swastika for legitimate purposes completely independent of Nazism. However, due to the widespread recognition of the Nazi swastika as a hate symbol, we have decided to only allow swastikas when part of a clear religious or cultural context.

5. Illegal Items, Items Promoting Illegal Activity and Highly Regulated Items

We respect the law and expect Afri Pearl Collections sellers to respect the law as well.

Illegal items, items that promote illegal activity, and stolen items are not allowed on Afri Pearl Collections. Neither are certain items that are subject to complex legal regulations or registration systems. Because Afri Pearl Collections is a global company, it’s important to abide by the laws of the markets in which you are selling. What is legal in one country may be illegal in another. All forms of illegal activity are strictly prohibited. Listings may not facilitate or promote illegal acts.

Counterfeit or unauthorized items are prohibited on Afri Pearl Collections. We consider counterfeit or unauthorized goods to be items that imitate an authentic good, particularly by using a brand’s name, logo, or protected design without the brand owner’s consent. Additionally, we may consider up-cycled or re-purposed items, even if using authentic materials, to be counterfeit if they are making use of a brand’s name, logo, or protected design without their permission. Examples of prohibited counterfeit or unauthorized goods include replica luxury and non-luxury items like bags and branded apparel.

Additionally, due to complex legal restrictions that vary by location, Afri Pearl Collections does not permit the sale of real estate, housing, or motor vehicles (for example: automobiles, motorcycles, boats, travel trailers, etc.).

We require sellers to follow all applicable laws for the items they list. Examples of items which may be subject to regulation include Native American crafts, plants and seeds, children’s products, and food products.

6. Internationally Regulated Items

Afri Pearl Collections provides a direct connection between buyers and sellers around the world. If you buy or sell an item from another country, or if you enter into a transaction with someone across international borders, you are responsible for complying with laws and regulations of the country of destination as well as your local laws.

When buying and selling internationally, you should comply with your local laws and be aware that other countries may have their own restrictions. You might be prohibited from exporting or importing certain items under international laws and regulations. Some transactions may require licences, permits, or other documentation. If you have questions about how to comply with the law, we recommend that you speak to a qualified professional.

When you use Afri Pearl Collections’ services, you are also responsible for complying with economic sanctions and trade restrictions, including those implemented by the Office of Ministry of Finance, Foreign Assets Control (“OFAC”) of the US Department of the Treasury. All Afri Pearl Collections members must comply with our Sanctions Policy, regardless of their location.

Afri Pearl Collections reserves the right to request that sellers provide additional information, disclose an item’s country of origin in a listing, or take other steps to meet compliance obligations.

You should be aware that third-party payment processors, such as PayPal, may independently monitor transactions for sanctions compliance and may block some transactions as part of their own compliance programmes. Afri Pearl Collections has no authority or control over the independent decision-making of these providers.

Examples of What is Allowed:

Sanctions or compliance programmes may have certain exceptions to their restrictions. For example, while Ministry of Finance and OFAC broadly prohibits transactions involving goods that originate from sanctioned areas, there are exceptions for informational materials such as publications, films, posters, phonograph records, photographs, tapes, compact discs, and certain artworks. Items that don’t originate from a sanctioned area but make a reference to a sanctioned area are generally permitted.

7. Pornography and Mature Content

As a creative community, we tend to be fairly liberal about what we allow on Afri Pearl Collections, but we draw the line at pornography. Beyond that, we restrict mature content so that people who are offended by this kind of material don’t have to see it. If you are selling mature content, we ask that you be respectful of differing sensibilities.

Pornography of any sort is prohibited on Afri Pearl Collections, whereas mature content is restricted.

Although pornography can be difficult to define, an item generally qualifies as pornography when it contains printed or visual material that explicitly describes or displays sex acts, sex organs, or other erotic behavior for the sole purpose of sexual arousal or stimulation.

We define mature content containing printed or visual depictions of human genitalia, sexual activity or content, profane language, sexual wellness items, violent images (within reason; see also Violent Items), and explicit types or representations of taxidermy. Click here to read more about how to properly list and tag mature content. Not all nudity is considered mature, and examples are listed below. If you find yourself questioning whether your item is mature, then it is likely a good idea to assume that it is mature content, and you should label it as such.

When deciding whether mature content crosses over the threshold into pornography, we take into consideration the explicitness of depictions of sexual activity or content.

Sanctions Policy

Afri Pearl Collections provides a direct connection between buyers and sellers around the world. When you use Afri Pearl Collections’ services (we’ll refer to Afri Pearl Collections.com, Pattern by Afri Pearl Collections, our mobile apps, and other services as our “Services”), you are responsible for complying with this policy, regardless of your location.

This policy is a part of our Terms of Use. By using any of our Services, you agree to this policy and our Terms of Use.

As a global company based in the US with operations in other countries, Afri Pearl Collections must comply with economic sanctions and trade restrictions, including those implemented by the Ministry of Finance and Office of Foreign Assets Control (“OFAC”) of the US Department of the Treasury. This means that Afri Pearl Collections or anyone using our Services can’t take part in transactions that involve designated people, places, or items that originate from those places, as determined by agencies like OFAC.

This policy applies to anyone that uses our Services, regardless of their location. It is up to you to familiarize yourself with these restrictions.

For example, these restrictions generally prohibit, but are not limited to, transactions involving:

1. Certain geographic areas, such as Crimea, Cuba, Iran, North Korea, and Syria, or any individual or entity operating or residing in those places;

2. Individuals or entities identified on sanctions lists such as OFAC’s Specially Designated Nationals (“SDN”) List or Foreign Sanctions Evaders (“FSE”) List;

3. Nationals of Cuba, regardless of location, unless citizenship or permanent residency outside of Cuba has been established; and

4. Items originating from areas including Cuba, North Korea, Iran, or Crimea, with the exception of informational materials such as publications, films, posters, phonograph records, photographs, tapes, compact disks, and certain artworks.

In order to protect our community and marketplace, Afri Pearl Collections takes steps to ensure compliance with sanctions programmes. For example, Afri Pearl Collections prohibits members from using their accounts while in certain geographic locations. If we have reason to believe you are operating your account from a sanctioned location, such as any of the places listed above, or are otherwise in violation of any economic sanction or trade restriction, we may suspend or terminate your use of our Services. Members are generally not permitted to list, buy, or sell items that originate from sanctioned areas. This includes items that pre-date sanctions, since we have no way to verify when they were actually removed from the restricted location. Afri Pearl Collections reserves the right to request that sellers provide additional information, disclose an item’s country of origin in a listing, or take other steps to meet compliance obligations. We may disable listings or cancel transactions that present a risk of violating this policy.

In addition to complying with Ministry of Finance, OFAC and applicable local laws, Afri Pearl Collections members should be aware that other countries may have their own trade restrictions and that certain items may not be allowed for export or import under international laws. You should consult the laws of any jurisdiction when a transaction involves international parties.

Finally, Afri Pearl Collections members should be aware that third-party payment processors, such as PayPal, may independently monitor transactions for sanctions compliance and may block transactions as part of their own compliance programmes. Afri Pearl Collections has no authority or control over the independent decision-making of these providers.

The economic sanctions and trade restrictions that apply to your use of the Services are subject to change, so members should check sanctions resources regularly. For legal advice, please consult a qualified professional.

Seller Protection Policy

Afri Pearl Collections’ Seller Protection can offer a little extra peace of mind to eligible sellers. When you qualify, Afri Pearl Collections will work with you to resolve cases, investigate chargebacks, and help you deal with any other issues that come up with your Afri Pearl Collections shop. This Seller Protection Policy explains the steps you must take to be eligible for Seller Protection and the types of items and transactions that may be covered.

1. Seller Eligibility Requirements

Eligible sellers are automatically enrolled in Seller Protection — there is no application process. Here’s what you need to do to make sure your shop is covered:

A. Keep your shop in good standing (that means you’re not violating any of Afri Pearl Collections’ policies).

B. Enroll in Afri Pearl Collections’ payment platform, Afri Pearl Collections Payments.

C. Fill out all of your Shop Policies (it’s especially important to have policies for returns, exchanges, and custom orders). Your Shop Policies have to comply with Afri Pearl Collections’ policies, as well as your local laws.

D. Use accurate photographs and descriptions when you list items.

E. Include reasonable and accurate processing times or dispatch-by dates.

F. Cooperate with investigations conducted by Afri Pearl Collections. Promptly provide any information requested by Afri Pearl Collections, and cancel and refund any transactions deemed invalid or unauthorized by Afri Pearl Collections.

2. Order Eligibility Requirements

Follow these steps to make sure your orders are covered by Afri Pearl Collections’ Seller Protection:

A. Dispatch your order according to the processing time or dispatch-by date you listed or as agreed upon through Afri Pearl Collections Messages.

B. Dispatch the order to the address provided on Afri Pearl Collections. If your buyer provides an alternate delivery address through Messages, be mindful of fraud or scams. You may choose to cancel and refund the order and ask the buyer to purchase the item again with the corrected delivery address.

C. Mark the order as dispatched after you send it out. If you use Afri Pearl Collections Postage Labels, the order will automatically be marked as dispatched.

D. Provide valid proof of dispatch. Valid proof can include a delivery or tracking number that shows the order route and delivery progress.

E. Use Afri Pearl Collections Payments to receive payment for the order.

3. Items and Transactions Not Eligible

While most items and transactions qualify for Seller Protection, there are a few exceptions:

A. Items sold in person via the Sell on Afri Pearl Collections app.

B. Subscriptions or other transactions in which the buyer submits a single payment for recurring deliveries (like item-of-the-month clubs).

C. Transactions processed outside of Afri Pearl Collections Payments, for example, through standalone PayPal or a personal check.

D. Any order or transaction that is fulfilled by the seller despite notice from Afri Pearl Collections that the order or transaction in question is invalid, fraudulent, or under investigation.

4. Seller Protection Benefits

If your shop and the order in question satisfy the eligibility requirements, Afri Pearl Collections will try to help you resolve Non-Delivery cases, Not as Described cases, and chargebacks. We may have to request additional information or assistance from you. For Non-Delivery or Not as Described cases, we’ll need you to respond to our inquiries within 3 calendar days or the time frame noted by Afri Pearl Collections in the case. If a chargeback is filed against you, we’ll need you to respond to any enquiries within 3 calendar days or the time frame indicated by Afri Pearl Collections. If you don’t give us the necessary information in time, we may not be able to help resolve the dispute. Please keep in mind that we can’t guarantee a resolution in your favour.

Seller Referrals Policy

Afri Pearl Collections sellers may receive credits to be used on our website and mobile apps (the “Services”) through Afri Pearl Collections’ referral programmes. This Seller Referrals Policy explains the requirements you need to meet in order to receive credits.

This policy is a part of our Terms of Use. By participating in one of Afri Pearl Collections’ referral programmes, you’re agreeing to this policy and our Terms of Use.

As an Afri Pearl Collections seller, you can receive credits toward listing items on our marketplace (“Listing Credits”) through Afri Pearl Collections’ Seller Referral Programme. To participate, sign in to your Afri Pearl Collections account and follow the directions on the Seller Referral page to invite friends who have not previously registered to sell on Afri Pearl Collections (“First-Time Sellers”). Valid invitations must include a unique link generated on the Seller Referral page. You may only send referral invitations to friends or individuals who consent to receiving this type of message. You must comply with any applicable local laws.

Both you and a First-Time Seller who receives a valid invitation from you will receive Listing Credits from Afri Pearl Collections after the First-Time Seller clicks the unique link from your invitation, opens an Afri Pearl Collections shop, and lists an item for sale.

Listing Credits may only be applied toward fees for listing new items or renewing existing listings. Listing Credits may not be applied toward a purchase on our marketplace or any previously accrued fees due to Afri Pearl Collections. Should you or the First-Time Seller use Listing Credits to list items that are prohibited by Afri Pearl Collections, the items shall be subject to removal by Afri Pearl Collections at its sole discretion and the redeemed Listing Credits shall not be reinstated. Listing Credits do not expire, but they will be voided within an Afri Pearl Collections account in the event of that account’s closure for any reason.

Credits are not transferable and may not be sold or exchanged for cash. If you or your friends do not comply with this policy or do not follow the directions on the referral pages or valid invitations, you may not receive the applicable credits. Afri Pearl Collections will not be liable for any such non-compliance. Invitations may expire.

Participation in the referral programmes may be limited to Afri Pearl Collections members located in certain countries or using certain currencies, and is void where prohibited by law. Afri Pearl Collections reserves the right to modify or terminate the referral programmes at any time.

Afri Pearl Collections reserves the right to cancel or rescind credits if it determines in its sole discretion that any party has violated this policy or Afri Pearl Collections’ Terms of Use, including through any fraudulent or misleading referral activity (for example, by using multiple identities, providing false or misleading information, or conducting any kind of funny business) or if the party’s Afri Pearl Collections account is closed for any reason.

Delivery Policy

Afri Pearl Collections offers a variety of services to make it easier for sellers to get their one-of-a-kind items into the hands of buyers quickly and securely. This Delivery Policy explains your delivery obligations as a seller and your rights and responsibilities when using Afri Pearl Collections’ postage labels services.

1. Delivering Your Items

Sellers are responsible for dispatching their sold items to buyers. If you’re using a delivery or fulfilment service, please keep in mind that you are ultimately responsible for making sure that your buyers receive their orders.

By selling on Afri Pearl Collections, you agree to:

A. Provide an accurate “dispatches from” address.

B. Specify your postage costs and processing times in your listings.

C. Dispatch items promptly after they are sold. Prompt delivery means that you dispatch each item within 30 days of purchase, unless you specify otherwise in your processing time or agree to a different delivery period with the buyer through Messages. Before you update your processing time for a specific order, you must first obtain your buyer’s consent.

D. Comply with all local and international delivery and customs regulations. We know that delivery and customs regulations can be tough to read, so check out these Help articles on international delivery using United States Postal Service (USPS), Canada Post, Royal Mail, Australia Post, Global Postal Shipping, and Yakit Delivery Partners. E. Dispatch to the address listed on the Afri Pearl Collections receipt.

F. Mark the order as dispatched when you dispatch it, or use a postage label purchased on Afri Pearl Collections, which automatically marks your order as dispatched. Remember that you may only mark an order as dispatched after you actually have dispatched it. When you mark an order as dispatched, the buyer will receive a notification.

G. Charge an appropriate amount for postage. US and Canadian sellers may be able to use calculated postage to have postage costs calculated automatically.

By entering tracking information or delivery confirmation on Afri Pearl Collections, you’re giving us permission to collect and share this data received from your chosen delivery company with the buyer.

In the unlikely event an order does not arrive, be prepared to provide valid proof of dispatch. Valid proof of dispatch must show that the item actually was dispatched and that it was sent to the address provided on Afri Pearl Collections. 2. Shipping Labels on Afri Pearl Collections

Sellers in the United States, Canada, UK, Australia, and India who accept Afri Pearl Collections Payments or PayPal as a payment method are able to purchase Postage Labels on Afri Pearl Collections.

By purchasing and using Postage Labels on Afri Pearl Collections, you agree that:

A. All postage labels will only be used to send corresponding Afri Pearl Collections orders.

B. Postage labels may not be transferred or sold to a third party.

C. You are fully responsible for the contents of any parcels you dispatch using Postage Labels on Afri Pearl Collections. In addition to Afri Pearl Collections’ policies, you agree to comply with the terms and conditions and any other policies or rules imposed by the carrier you use to dispatch your items.

D. Delivery services are provided by the applicable third-party carrier, not Afri Pearl Collections, and you are responsible to review, accept and abide by the carrier’s terms and conditions, including their privacy policy, in connection with your use of their services. Afri Pearl Collections is not liable or responsible for any issues you may have with a carrier’s services and you should contact the applicable carrier as needed. In addition, Afri Pearl Collections is not responsible for any issues you may encounter while items you dispatch using Postage Labels on Afri Pearl Collections are in transit. That means that if an item is lost, damaged, or arrives later than expected, you will have no recourse against Afri Pearl Collections, regardless of Afri Pearl Collections’ involvement in resolving the issue. Please review the applicable carrier’s terms and conditions for more information on how they handle parcels that are lost, damaged, or delayed.

E. Afri Pearl Collections reserves the right to remove your access to Afri Pearl Collections Postage Labels at any time and for any reason. F. You acknowledge and consent to Afri Pearl Collections sharing your information with your chosen delivery company in order to complete your requested transaction subject to our Privacy Policy.

USPS Labels

US sellers can purchase USPS postage on Afri Pearl Collections to fulfil their orders. By using USPS postage, you agree to comply with the USPS rules and USPS Privacy Statement.

Sellers may request a refund for USPS postage within 10 days of creating a label, as long as the label has not been used to dispatch a package. USPS reviews refund requests, and Afri Pearl Collections will notify sellers once a request is approved or denied. FedEx Labels

US sellers can purchase FedEx postage labels (including FedEx Smart Post) on Afri Pearl Collections to fulfil their orders. By using FedEx postage labels, you agree to comply with the FedEx Service Guide.

Sellers may request a refund for FedEx postage labels within 10 days of creating a label, as long as the label has not been used to dispatch a package. Afri Pearl Collections processes refund requests, and we will notify sellers after their request has been approved or denied. If you are using FedEx Smart Post, you must file claims for liability coverage for FedEx SmartPost postage labels on Afri Pearl Collections for eligibility. See additional applicable FedEx SmartPost Terms. FedEx will not be liable for FedEx SmartPost claims filed directly with FedEx. Canada Post Labels – Solutions for Small Business

Sellers can purchase Canada Post postage labels on Afri Pearl Collections with a valid Solutions for Small Business account only. Most Afri Pearl Collections sellers should qualify for a Solutions for Small Business account, but eligibility is determined by Canada Post and is not guaranteed. By using Canada Post postage labels, you agree to comply with Canada Post rules.

Sellers may request a refund for Canada Post postage labels within 15 days of creating a label, as long as the label has not been used to dispatch a package. Canada Post reviews refund requests, and Afri Pearl Collections will notify sellers after a request has been approved or denied. Royal Mail Labels

UK sellers can purchase Royal Mail postage on Afri Pearl Collections to fulfil their orders. By using Royal Mail postage, you agree to comply with the Royal Mail Afri Pearl Collections Programme rules including Royal Mail Restricted and Prohibited Goods, and the UK Government Webpage on “Shipping Dangerous Goods”.

UK sellers acknowledge and agree that any Royal Mail Trademarks © and Trademarks of Royal Mail Group Ltd displayed on Afri Pearl Collections.com or in any Afri Pearl Collections communication may not be copied or reproduced in any way, without the further written permission of Royal Mail.

Global Postal Delivery

US sellers can purchase Global Postal Delivery postage on Afri Pearl Collections to fulfil international orders (“Global Postal Delivery Postage”). Global Postal Delivery Postage is fulfilled by Asendia through one of their national postal partners. By using Global Postal Delivery Postage, you agree to comply with the applicable Asendia Terms & Conditions, which will depend on the destination of your package. For qualifying orders, Sellers may request a refund for a Global Postal Delivery Postage within 10 days of creating a label, as long as the label has not been used to dispatch a package. Sellers located in India may purchase postage labels from delivery partners through Yakit (“Yakit Delivery Partner(s)”) to fulfill domestic and international orders. 3. Return Postage Labels

U.S. Sellers who accept returns from buyers and dispatch packages using USPS, can purchase a USPS return postage label on Afri Pearl Collections. Return postage labels are available for packages purchased by U.S. buyers who made the purchase as a registered Afri Pearl Collections user. USPS return postage labels are available for packages dispatched from and to addresses in the 50 U.S. states only (currently labels are not available for APO/DPO/FPO military addresses or U.S. territories). 4. Delivery Insurance

When you purchase and use Postage Labels on Afri Pearl Collections, you can purchase parcel insurance, when available, to protect your packages. Insurance is available through Shipsurance for USPS and FedEx postage labels and through Canada Post for postage labels purchased from Canada Post. Parcel compensation is available through Royal Mail for postage labels purchased from Royal Mail.

Shipsurance Insurance

You may purchase parcel insurance from Shipsurance Insurance Services, Inc. for packages that are dispatched using USPS, FedEx, or Global Postal postage labels. If you choose to purchase insurance from Shipsurance, you agree to the Shipsurance Coverage Rules.

Royal Mail Compensation

All Royal Mail delivery services offer inclusive compensation at different levels. When selecting the Royal Mail service, make sure you check the compensation level is right for the value of the item you are sending. Compensation claims for packages sent using Royal Mail labels are handled exclusively by Royal Mail.

5. Fees

The cost of a postage label will depend on the origin, destination, weight, mail class, package type, and dimensions of the package. If you add signature confirmation, insurance, or Royal Mail parcel compensation, fees will be added to the total cost of the label at the point of purchase. All fees for USPS, FedEx, Canada Post, Royal Mail, Australia Post, Global Postal Shipping, and Yakit Delivery Partner labels, and Shipsurance, Canada Post parcel insurance, Royal Mail parcel compensation, and Australia Post parcel insurance will appear separately on your payment account and will specify the name of the service provider and the postage label number. The fees for shipping labels and shipping insurance will appear in US Dollars (USD), unless specified below.

If you purchase Canada Post postage labels, the cost of each postage label, taxes, and parcel insurance will appear separately on your payment account. When you purchase a Canada Post label, the fees will appear in Canadian Dollars (CAD) and US Dollars (USD) in the total cost summary. All final label charges will be listed on your payment account in CAD.

If you purchase Royal Mail postage labels, the cost of each postage label, taxes, and parcel compensation will appear separately on your payment account. When you purchase a Royal Mail label, the fees will appear in British Pounds (GBP). All final label charges will be listed on your payment account in GBP.

If you purchase Australia Post postage labels, the cost of each postage label, taxes, and parcel insurance will appear separately on your payment account. When you purchase a Australia Post label, the fees will appear in Australian Dollars (AUD). All final label charges will be listed on your payment account in AUD.
